BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, sitting in regular meeting that: Section 1: That Chapter 6, Land Use Regulations, Section 6401(I)Accessory Buildings and Structures of the Zephyrhills Land Development Code is hereby created and incorporated and shall henceforth read as follows: CHAPTER 6 Land Use Regulations: SECTION 6401. Accessory Buildings and Structures: I. Portable Shelters. Portable shelters shall be defined as any roof structure designed to shelter vehicles, persons, goods, merchandise, equipment, materials or property of any kind that is capable of being carried or moved, and which does not require a building permit for construction or installation. Any portable shelter must be placed in the rear yard and comply with rear line and sideline setbacks for the zoning district where it is erected. Rear yard shall be defined as that portion of the lot located behind that point of the principal use structure furthest from the front property line. Portable Shelters found in violation of this ordinance shall be removed within thirty(30) days after notification by the Building Official, or his designees, or ninety (90) days if said structure predates the implementation of this Ordinance, unless said time is extended by the Building Official for good cause. Section 2: The provisions of this Ordinance are severable, and if any section, sentence, clause, or phrase is for any reason held to be unconstitutional, invalid, or ineffective, this holding shall not affect the validity of the remaining portions of the Ordinance, it being expressly declared to be the City Council's intent that it would have passed the valid portions of this Ordinance without the inclusion of any invalid portion or portions. Section 3: This Ordinance shall become effective immediately upon its passage.
