DR BK 4x33 , PG '7'7'3 <br /> 2 of le <br /> than storm water; and <br /> WHEREAS, the City of Zephyrhills hereby finds that they desire to protect and promote the <br /> public health,safety and general welfare through the management of stormwater runoff; and <br /> NOW,THEREFORE,BE IT ORDAINED by the City of Zephyrhills,Florida, as follows: <br /> ARTICLE 1 -GENERAL PROVISIONS <br /> SECTION 1-1. SHORT TITLE: • <br /> This Ordinance shall be known as the City of Zephyrhills Stormwater Quality Management Ordinance. <br /> SECTION 1-2. FINDING OF FACTS: <br /> The contribution of pollutants through discharges from storm sewer systems has a significant impact <br /> on the receiving waters in City of Zephyrhills. Improperly treated discharges from industrial activities <br /> and interconnected Municipal Separate Storm Sewer Systems (MS4's) and illicit discharges from <br /> spilling,dumping or disposal of material other than stormwater to the Municipal Separate Storm Sewer <br /> System will adversely affect the quality of waters receiving such discharges. The United States <br /> Environmental Protection Agency(USEPA),pursuant to Title 40, Section 122.26 of the Code of Federal <br /> Regulations,has mandated that municipalities provide the legal authority to control discharges to the <br /> Municipal Separate Storm Sewer system under the National Pollutant Discharge Elimination System <br /> (NPDES)Permit in order to control the quality of discharges from the Municipal Separate Storm Sewer <br /> System. The City of Zvpi:;hilae, :� u erefoi:, fakis it ;lc--cssary and in the puziic interest, to <br /> protect the quality of waters receiving stormwater discharges,for the health,safety,and general welfare <br /> of the citizens of The City Zephyrhills. <br /> SECTION 1-3. APPLICABILITY: <br /> The regulations herein set forth shall apply to all the incorporated areas of The City Zephyrhills. <br /> ARTICLE 2-DEFINITIONS <br /> SECTION 2-1. DEFINITIONS: <br /> Unless specifically defined below,words or phrases used in this Ordinance shall be interpreted so as to <br /> give them the meaning they have in common usage and to give this Ordinance its most reasonable <br /> application. Use of the word"shall"rens mandatory and not merely discretionary. <br /> A. BEST MANAGEMENT PRACTICES (BMP's) - Schedules of activities, prohibitions of <br /> practices, maintenance procedures, and other management practices to prevent or reduce <br /> pollutants from entering the Municipal Separate Storm Sewer System(MS4)or being discharged <br /> from the MS4.BMP's include,but are not limited to,treatment methods and practices to control • <br /> the discharge of pollutants. <br /> 2 <br />
