W-0 3(7 WHEREAS, the City Council of the City of Zephyrhills, Florida, as governing body of the - �o municipal corporation of the City of Zephyrhills is authorized by Florida Statute 171°.051 of the Laws l.—.o of Florida and by the municipal charter, to initiate Ordinances to contract,the municipal boundaries m of said City; and WHEREAS, the City Council of the City of Zephyrhills, Florida, has determined that the property to be deannexed does not meet the criteria set forth in Florida Statutes 171.043; and WHEREAS, the City Council of the City of Zephyrhills, Florida believes that it is in the best interest of the citizens of the City of Zephyrhills to exclude said lands from the corporate limits of the City of Zephyrhills. NOW, THEREFORE, BE IT ENACTED AND ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows: SECTION 1: That the following described lands, lying and? eipg.situate within the corporate limits of the City of Zephyrhills, to-wit; Tract 111, LESS the North 200.00 feet and the East 15.00 feet; and Tract 114, LESS the South 60.00 feet and LESS the East 15.00 feet of the North 75.00 feet, in Section 35, Township 25 South, Range 21 East,ZHPHYRH LLS COLONY COMPANY LANDS, as per plat recorded in Plat Book 1, page 55, Public Records of Pasco County, Florida. Containing 5.90 acres MOL. be, and the same is hereby excluded from the corporate city limits of the City of Zephyrhills, Florida, a municipal corporation. SECTION 2: Said lands are undeveloped,uninhabited and unbenefited by municipal services and do not meet the criteria of Florida Statute 171.043. SECTION 3: That the City of Zephyrhills,Florida, has been given authority by the legislature of the state of Florida, pursuant to Florida Statute 171.051 and pursuant to the Charter of the City of Zephyrhills,to deannex and exclude areas from said City and to contract the city limits or territorial boundaries upon approval of the City Council of the City of Zephyrhills, Florida, of said contraction duly expressed by Ordinance. SECTION4: That it is the intention of the City Council of the City of Zephyrhills, Florida, to exclude the above-described lands from said City and contract its territorial limits and the boundary lines of said City are hereby redefined and contracted so as to include said area of land from within its territorial limits upon the final passage of this Ordinance. SECTION 5: That this Ordinance shall be published in a newspaper of general circulation for two (2) consecutive weeks and that proof of publication of this Ordinance shall be filed herein.
