AN EMERGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, DECLARING A LOCAL EMERGENCY AND LOCAL EMERGENCY ORDERS REGARDING SALES AND PERSONAL USE OF FIREWORKS AND SPARKLERS; PROVIDING FOR PENALTIES HERETO; AND PROVIDING FOR AN EFFECTIVE DATE. .'f0,, r ;�..:, F�O'. „ : . • l:.ti._^i; orf .l N.`6 )28 WHEREAS, the City Council of the City of Zephyrhills has encountered and will continue - to encounter certain conditions hereinafter described which constitute a clear and present threat to the lives and property of the citizens of the City of Zephyrhills; and WHEREAS, such conditions are enumerated and described as follows: An exceptional and extended lack of rain, resulting in water shortages, drought and extremely unsafe fire conditions, all presenting an extreme fire hazard and consequent imminent and continuing danger and peril to the public safety, health and welfare of the City of Zephyrhills, Florida; • and WHEREAS, the geographical area of the City of Zephyrhills' is threatened arid affected by such conditions is described as follows: The entire city limits of the City of Zephyrhills, Florida; and WHEREAS, Chapter 252, Florida Statutes, empowers the city Council; of the City of Zephyrhills to exercise extraordinary powers during the existence of a State of Local Emergency, including the exercise of certain powers by Emergency Orders issued by the City Council of the City of Zephyrhills. NOW THEREFORE, be it ordained by the City Council of-the City of Zephyrhills, Florida, sitting in emergency session, that: 1. All procedures and formalities required by the laws of the City of Zephyrhills', as a political subdivision are hereby waived pursuant to Chapter 252.38(5), Florida Statutes, to the extent necessary and required to effect the purposes of this emergency.Declaration. 2. The City Council of the City of Zephyrhills does herby issue the following within Emergency Orders required to protect the health, welfare and safety of the people and property of the citizens of the City of Zephyrhills. FIRST: Effective immediately, the sale of all fireworks, as defined in Section 111 791.01(4)(a),Florida Statutes, and "sparklers", as defined in Section 791.01(8), Florida Statutes, is hereby prohibited within the city limits of the City of Zephyrhills, Florida. SECOND: effective immediately, all temporary use permits for the sale of fireworks are hereby cancelled and of no further validity or effect. Further, no such temporary use permits shall be issued by the City until these Local Emergency Orders are rescinded or otherwise modified.
