<br /> NOW THEREFORE, be it ordained by the City Council of the City of 1011-4
<br /> 11.1 p
<br /> Zephyrhills, Florida, sitting in regular session, as follows: 01
<br /> SECTION 1: Definitions:
<br /> For the purposes of this Ordinance,the following terms, phrases, words, and their
<br /> derivations shall have the meaning given herein. When not inconsistent with the context,
<br /> words in the present tense include the future, words in the plural number include the
<br /> singular number, and words in the singular number include the plural number. The word
<br /> "shall" is always mandatory and not merely directory.
<br /> (a) "Grantor"-The City of Zephyrhills,Florida.
<br /> (b) "Grantee"-Peoples Gas System, a Division of Tampa Electric Company, its
<br /> successors and assigns.
<br /> (c) "Gas.TJtiiity System"-A system installed and operated in the franchise area in
<br /> accordance with the applicable provisions of the Public Service Commission establishing
<br /> technical standards, service areas,tariffs and operating standards, which shall include but
<br /> not be limited to; the erection, installation, extension, maintenance and operation of a
<br /> system of works, pipes, pipelines and all necessary apparatuses, machinery, structures
<br /> and appurtenances for the distribution of gas.
<br /> (d) "Gas"-Any natural,manufactured,propane/air mixed and/or commingled gas
<br /> which is capable of being distributed through pipes to customers.
<br /> (e) "Franchise Area"-That area for which Grantee provides gas services, for the
<br /> purpose of transporting, distributing, and selling natural gas, manufactured gas,
<br /> propane/air mixed gas and/or commingled gas which is distributed through pipes within
<br /> the corporate city limits of the Grantor.
<br /> (f) "Gross Revenues"-Revenues from the sale of gas, net of customers credits,
<br /> and calculated in accordance with the municipal public tax authorized by Section
<br /> 111 166.231,Florida Statutes,to residential, commercial, and industrial customers all within
<br /> the corporate limits of the City.
<br /> (g) "Right-of-Ways"-All of the public streets, alleys, highways, waterways,
<br /> bridges, easements, sidewalks and parks of the City, as they now exist or may be
<br /> hereafter constructed, opened, laid out or extended within the present limits of the City,
