/ I111111111111111111111111111111111111lIII 1/111111 <br /> \ 98076466 <br /> ORDINANCE NO.: 696 <br /> AN EMERGENCY ORDINANCE OF THE CITY <br /> COUNCIL OF THE CITY OF ZEPHYRHILLS, <br /> FLORIDA, PROHIBITING THE SALE AND USE OF <br /> FIREWORKS WITHIN THE CITY OF <br /> ZEPHYRHILLS FOR A PERIOD OF FIFTEEN (15) <br /> DAYS FROM THE EFFECTIVE DATE HEREOF, OR <br /> UNTIL SUCH TIME AS THE TERMINATION OF <br /> THE EXISTING STATE OF EMERGENCY; <br /> PROVIDING FOP PENALTIES .HERETO; AND - <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS,the State of Florida is experiencing a series of extensive forest and brush fires, <br /> including Pasco County, Florida, due to abnormally dry whether conditions; and , <br /> WHEREAS, the State Division of Emergency Management has determined that as of June <br /> 24, 1998 such fires have burned more than 100,000 acres; and <br /> WHEREAS, the Governor of the State of Florida has issued Executive'Order 98-41, dated <br /> June 7, 1998, declaring a state of emergency throughout Florida as.a result of the continuing fires; <br /> and <br /> WHEREAS,the Governor's Executive Order expressly recognizes the extreme potential for <br /> additional fires that may threaten life and property; <br /> WHEREAS,the State Division of Emergency Management has determined that the state of <br /> Florida will continue to experience whether conditions conducive to fire activity; and <br /> WHEREAS,the State Division of Forestry has issued a ban on burning permits throughout <br /> the State, including Pasco County;and <br /> WHEREAS, the sale and personal use of fireworks and sparklers, as well as the discarding <br /> of lit cigarette butts outdoors unnecessarily increase the risk of additional fire in the City of <br /> Zephyrhills with the attendant risk to life and property. <br /> NOW THEREFORE, be it ordained' by the City Council of the City of Zep'hyrhills, <br /> Florida, sitting in emergency session, that: <br /> 1. A State of Emergency does hereby exists, as a result of the conditions set forth <br /> and the preamble hereto. <br /> 2. That during the local State of Emergency, the personal sale and use of <br /> fireworks and sparklers, as well the discarding of lit cigarette butts outdoors shall <br /> hereby be prohibited. <br /> 3.
