CITY COUNCIL OF <br /> THE CITY OF ZEPHYRBILLS, FLORIDA, A <br /> MUNICIPAL CORPORATION, ESTABLISHING <br /> PROCEDURES FOR THE RETENTION OF <br /> CONSULTANTS BY THE CITY OF <br /> ZEPHYRHILLS; AND PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> BE IT ORDAINED by the City Council of the City of'Zephyrhills, <br /> Florida, sitting in regular meeting that: <br /> Section 1. Purpose: The purpose of this Ordinance.is:to`establish <br /> a procedure for retention of any consultant for the provision of services to the City <br /> of Zephyrhills for any municipal purpose. - '` <br /> Section 2. Definition (Consultant). The term "consultant" shall <br /> be interpreted to include but.not be limited to any individual, corporation or <br /> professional association with training or expertise in planning engineering, natural <br /> science, economics law, government, finance and/or;grant applications; who, <br /> regularly holds himior itself out as an expert and is an expert:its. field and is <br /> retained by the City of Zephyrhills to render advise, perform tasks, compile <br /> reports, conduct studies, or other acts in the ordinary course of municipal business, <br /> and is not a city employee or a city official. <br /> Section 3. Procedure for Retaining Consultants: Whenever the City <br /> of Zephyrhills determines that it is necessary for it to retain a consultant, the City <br /> shall follow the following'procedure. <br /> a. When the construction cost of the project'is estimated.to be in <br /> excess of One Hundred and Twenty Thousand Dollars($120,000.00), or when the <br /> consultant's fee is estimated to cost in excess of Ten Thousand Dollars <br /> ($10,000.00), the City shall publish a legal advertisement requesting proposals <br /> from qualified firms. The publication shall include a general description of the <br /> project, and the scope of services to be performed. The City shall comply with <br /> the Consultant's Competitive Negotiation Act,Florida Statute 287.055, as well as <br /> with Section 800 of the City of Zephyrhills Fiscal Management Policy as both now <br /> exist or may be amended from time to time. Any such contract shall be approved <br /> by City Council. <br /> b.
