—'---� <br /> Et::17'°___TL DitSpPlerk1111llllli I1llll <br /> 96090100 <br /> JED PITTMAN, PASCO COUNTY CLERK <br /> ORDIN CE NO. 641 OR/BK 362 �� 1PGf mania <br /> AN ORDINANCE OF THE CITY COUNCIL OF <br /> THE CITY OF ZEPHYRHILLS, FLORIDA, <br /> ENACTING PROCEDURES FOR ENFORCEMENT <br /> OF THE CODE OF ZEPHYRHILLS; PROVIDING <br /> FOR ISSUANCE OF CITATION TO VIOLATORS; <br /> PROVIDING FOR THE CREATION OF A <br /> UNIFORM FINE SCHEDULE; PROVIDING FOR <br /> PAYMENT OF FINES OR REQUEST FOR <br /> HEARING; PROVIDING FOR ASSESSMENT OF <br /> PENALTIES UPON DETERMINATION OF GUILT; <br /> PROVIDING FOR ISSUANCE OF WARNING; <br /> PROVIDING FOR SANCTIONS FOR-FAILURE TO <br /> PAY FINE OR REQUEST HEARING AND <br /> PROVIDING FOR EFFECTIVE DATE. <br /> BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows: <br /> SECTION 1: Any Zephyrhills code enforcement officer is authorized to issue a citation to <br /> a person when, based upon personal investigation,the officer has reasonable cause to believe that the <br /> person has committed a civil infraction in violation of the duly enacted code or ordinance of the City <br /> of Zephyrhills. Prior to issuing the citation, a code enforcement officer shall provide notice to the <br /> person that the person has committed a violation of a code or ordinance and shall establish a <br /> reasonable time periodwithin which the person must correct the violation. Such tulle period shall <br /> be no more than thirty(30) days. If, upon personal investigation, a code enforcement officer finds <br /> that the person has not corrected the violation within the time period, a code enforcement officer may <br /> issue a citation to the person who has committed the violation. A code enforcement officer does not <br /> have to provide the person with a reasonable time period to correct the violation prior to issuing a <br /> citation and may immediately issue a citation if a repeat violation is found or if the code enforcement <br /> _ J <br /> officer has reason to believe that the violation presents a serious threat to the public health, safety or <br /> welfare or if the violation is irreparable or irreversible. <br /> SECTION 2: The following are designated code enforcement officers for the enforcement <br /> of the Municipal Code of the City of Zephyrhills: <br /> a. Code Inspectors; b. Law Enforcement Officers _ - <br /> c. Fire Safety Inspectors <br /> SECTION 3: City Council shall adopt a uniform fine schedule, which shall be applicable to <br /> all violations of the code unless specifically excluded. All such violations of the code included in the <br /> uniform fine schedule shall constitute a civil infraction. The officer issuing the citation shall cause to <br /> be displayed on the citation the amount of the fine to be assessed for the violation. <br /> SECTION 4: The violator shall pay the fine displayed on the citation to the City of <br /> Zephyrhills within ten(10)days of the issuance. If the violator desires a hearing, on the propriety of <br /> the citation, then the violator must request same in person at the office of the Clerk of the Court, <br /> Pasco County Courthouse, Dade City, Florida. Said request must be made within ten(10) days of <br /> the issuance of the citation.
