J BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, sitting in regular meeting that: Section 1: That Section VI(A)is amended and Section VI(C)-of the,Zephyrhills:Transportation Impact Fee Ordinance is hereby adopted and shall henceforth read as"follows:.. SECTION VI Time of Payment: A. The "Fair Share Fee" shall be due and paid based on the following schedule: 1. Twenty-five Percent(25%)shall be paid upon`the issuance of any building or 111 development permits for any new or additional land development activity generating traffic except singlefamily and duplex dwellings. 2. Seventy-five percent(75%) shall be paid prior to issuance-of a Certificate of Occupancy for the structure. The fee for each single family or duplex dwelling is due prior to issuance of a Certificate of Occupancy for the dwelling. Impact fees paid shall be based on the rates in effect at the time of payment. C. Development which results in new jobs will be eligible for a rebate of One Percent (1%)of transportation impact fees for each new full timeequivalent employee on the payroll of the occupant(s) of the development on the first anniversary after issuance of a Certificate of Occupancy. Rebate shall not exceed Seventy-five Percent (75%) of transportation.impact feesderived from the development. Section 2: The provisions of this Ordinance are severable, and if any section, sentence, clause, or phrase is for any reason held to be unconstitutional, invalid, or ineffective, this holding shall not affect the validity of the remaining portions of the Ordinance, it being expressly-declared to be the City Council's intent that it would have passed the valid portions of this Ordinance without the inclusion of any invalid portion or portions. Section 4: This Ordinance shall become effective immediately upon its passage.
