<br /> AN ORDINANCE OF THE CITY OF ZEPHYRHILLS ,
<br /> FLORIDA, REZONING LANDS WITHIN SAID CITY,
<br /> PURSUANT TO THE REQUEST OF THE OWNER OF SUCH
<br /> LANDS AND IN ACCORDANCE WITH FLORIDA STATUTE
<br /> 166 .041 (3) (c) 1 .
<br /> WHEREAS, HERMAN HEINLEIN, is the owner of the land
<br /> hereinafter described in Section 1 , and
<br /> - J
<br /> WHEREAS, the Zephyrhills Planning Commission has decreed
<br /> that in keeping with the surrounding proper-ties and-- the
<br /> City' s Comprehensive Plan that the appropriate zoning for.
<br /> said property should be Estate Residential (ER);, and
<br /> WHEREAS the property to be rezoned does involve less than
<br /> five percent (5%) of the total land area of the City of
<br /> Zephyrhills and the City is thereby empowered to rezone same
<br /> in accordance with Florida Statute 166 .041 (3) (c) 1 .
<br /> NOW, THEREFORE, BE IT ENACTED AND ORDAINED by the City
<br /> Council of the City of Zephyrhills , Florida, as follows :
<br /> SECTION 1 . That the following described lands , lying and
<br /> being situate in Pasco County, Florida, to-wit :
<br /> Tracts 113 , 128 , and those portions ofjracts
<br /> 114 and 127 lying East of the CSX Railroad
<br /> Right of Way in Section 1 , Township 26 South , - -
<br /> Range 21 East , Zephyrhills Colony Company -~. -
<br /> Lands , according to plat recorded in Plat',Book
<br /> 1 , page 55 , Pasco County, Florida; and -
<br /> Northeast * of Northeast 4 of Section 12 ,-
<br /> Township 26 South , Range 21 East , and
<br /> Northeast 4 of Southeast 4 of Northeast 4 of
<br /> Section 12 , Township 26 South , Range 21 East ,
<br /> and North 2 of Northwest 4 of Southeast 4 of
<br /> Northeast 4 of Section 12 , Township 26 South,
<br /> Range 21 East, according to plat recorded in
<br /> Plat Book 2 , page 16 , Pasco County , Florida.
<br /> be, and the same is hereinafter rezoned and hpnceorth, ' s;aid
<br /> properties zoning designation shall be Estate Residential -
<br /> (ER) , in accordance with the Zoning Regulations of ,the" City
<br /> of Zephyrhills , dated July 28 , 1986 and incorporated by
<br /> reference into Zephyrhills City Ordinance No. 397', -known as
<br /> the "City of Zephyrhills Zoning Ordinance" .
<br /> SECTION 2 . This Ordinance shall become law upon being
<br /> passed by the City Council of the City of Zephyrhills after
<br /> three (3) readings and execution by the presiding officer and
