ORDINANCE NO. 517 <br /> 115. <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF ZEPHYRHILLS , FLORIDA, PROVIDING FOR <br /> RECOVERY OF COSTS OF REPAIR OR DEMOLITION OF <br /> UNSAFE BUILDINGS , PROVIDING FOR A LIEN AND <br /> CHARGE UPON PROPERTY, ENFORCEMENT OF SUCH <br /> LIEN, PROVIDING FOR RECOVERY BY THE CITY OF <br /> COSTS AND ATTORNEY FEES IN ENFORCING SUCH <br /> LIEN. <br /> WHEREAS, the City of Zephyrhills , Florida, has previously <br /> adopted by reference in Ordinance No . 430 , the "Standard Code. <br /> for the Elimination or Repair of Unsafe Buildings" , and <br /> WHEREAS , said Code mandates that procedures for recovery <br /> of funds expended by the City for repair or demolition of <br /> unsafe buildings be established . <br /> NOW, THEREFORE, BE IT ENACTED AND ORDAINED by the City <br /> Council of the City of Zephyrhills , Florida, as follows : <br /> SECTION 1 : REPAIR AND DEMOLITION UPON FAILURE OF OWNER <br /> TO PERFORM; COST TO BE A LIEN UPON PROPERTY; AND INTEREST ON <br /> LIEN. <br /> If an owner fails to repair or demolish a building or <br /> structure after notice or hearing, the City may cause the <br /> condition to be remedied by the City or let same work out .for <br /> bid . Said work shall be performed at the expense of the <br /> owner of the property. After causing the coedit-ionto be <br /> remedied , the City Manager shall certify to th-e City Clerk , <br /> the expense incurred in remedying the condition. The ;= City <br /> shall thereafter prepare a lien which shall be recorded o£- <br /> Public Record and constitute a -charge upon the-property `whi_ch <br /> shall be payable, with ten percent ( 107) interest from the <br /> date of such certification until paid . The lien or charge <br /> shall be a first and prior lien against the property subject <br /> only_to the lien for taxes . <br /> SECTION 2 : ENFORCEMENT OF LIEN: - _ <br /> Upon the failure of the owner of the property- to pay ` th.e <br /> , lien, the City may enforce said lien in the -same manner__ as <br /> tax liens or assessments in favor of the City or_ ;other; <br /> governmental agencies and shall be certified by-the Clerk to <br /> the City Attorney for that purpose . <br /> Record and Return to:' <br /> C <br /> j _ ity.
