<br /> AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, REZONING LANDS
<br /> WITHIN SAID CITY, PURSUANT TO THE REQUEST OF THE OWNERS OF SUCH
<br /> LAND AND IN ACCORDANCE WITH FLORIDA STATUTE 166 .041 ( 3) (c) 1.
<br /> WHEREAS, OAKLEY GROVES, INC. , a Florida Corporation, is the
<br /> owner in fee of the lands hereinafter described in Section 1, and
<br /> WHEREAS, said OAKLEY GROVES, INC. , a Florida Corporation' has
<br /> applied for rezoning of said parcel from County -AR to City C2_,
<br /> and
<br /> WHEREAS, the Planning Commission has recommended approval- of
<br /> the owners application for rezoning; and
<br /> y
<br /> WHEREAS, the property to be rezoned does involve less than
<br /> five percent ( 5%) of the total land area of the City of
<br /> Zephyrhills and the City is thereby empowered to rezone same in
<br /> accordance with Florida Statute 166 . 041 ( 3 ) (c) 1.
<br /> NOW, THEREFORE, BE IT ENACTED AND ORDAINED by the City
<br /> Council of the City of Zephyrhills, Florida, as follows:_
<br /> SECTION 1. That the following described lands, lying and
<br /> being situate in Pasco County, Florida, to-wit: ' -
<br /> Commence at the Northeast corner of the SE ' 1/4 of Section -34,
<br /> Township 25 South, Range 21 East, Pasco County-,, Florida ' thence
<br /> along the North line of said NE a of SE 4, rut N-89°58" 35"-W,
<br /> 193 .17 feet to the West right-of-way line of t7.JS Hwy,J - 301,
<br /> thence along said line run S-01°09 ' 30"-E, 25. 00 feet 'to-the South
<br /> right-of-way line of Sunnyside Drive, for a POINT OF BEGINNING;
<br /> thence continuing along the West right-of-way line of U.S. Hwy.
<br /> 301, run S-01°09 ' 30"-E, 0 .38 feet, thence N-88°51 ' 04"-E, 10 . 00
<br /> feet, thence S-00°07 ' 42"-W, 609. 07 feet, thence N-89°33 ' 48"-E,
<br /> 32 . 00 feet, thence S-00°04 ' 30"-W, 691. 76 feet, to the Northeast
<br /> corner of SPANISH TRAILS VILLAGE, as recorded in Plat Book 13,
<br /> Pages 59 and 60, Public Records of Pasco County, Florida, thence
<br /> along the North boundary of said subdivision, and leaving
<br /> aforesaid right-of-way line, run N-89°58 ' 40"-W, _- 843.:32 feet,
<br /> thence N-00°09 ' 28"-E, 1300. 77 feet to the South right.-of-way.,line
<br /> of Sunnyside Drive, thence along said line S-89° 8 ' 35"-E, 800_.0
<br /> feet to the POINT OF BEGINNING; containing 24 . 71 acres.
<br /> be, and the same is hereby rezoned and henceforth,,. `said,
<br /> properties zoning designation shall be City C2 . J -
<br /> SECTION 2. This Ordinance shall become law upon being
<br /> passed by the City Council of the City of Zephyrhills after three
<br /> (3 ) readings and execution by the presiding officer and the clerk
<br /> of that body in accordance with Florida Statute 166. 041, Laws of
<br /> Florida.
