denial of an application for a license or permit or a notice 'of <br /> suspension or revocation of a license or permit, the aggrieved <br /> party may file a notice of appeal with the City Council. <br /> (2) The notice of appeal shall be filed with the ' City <br /> Council. The notice of appeal shall be accompanied by payment of <br /> a filing fee of fifty dollars ( $50 .00) to cover administrative <br /> costs. Upon receipt of the notice of appeal and upon payment of <br /> the accompanying fifty dollars ( $50 .00) filing fee, the City <br /> Council shall schedule a hearing for as soon as the Council ' s <br /> calendar will allow. The City Council shall provide the <br /> appellant with at least ten .( 10 ) days ' notice of the time and <br /> place for the hearing. <br /> (3 ) If, at the conclusion of the hearing, the City Council-= <br /> finds that the license or permit should- not have been deriied;y <br /> suspended, revoked, or cancelled, it shall so notify the City <br /> Manager, who shall immediatley grant or reissue the license: or <br /> permit. - <br /> Section 6-2 . Notice . Any notice required under this Ordinance <br /> shall be accomplished by sending a written notification by <br /> certified mail to the mailing address set forth on the <br /> application for the license or a permit. This mailing address <br /> shall be considered the correct mailing address unless the City <br /> Manager has been otherwise notified in writing. <br /> Section 6-3 . Immunity from Prosecution. The City or any <br /> Department shallbe immune from prosecution, civil or criminal, <br /> for reasonable, good-faith trespass upon an adult entertainment <br /> establishment while acting within the scope of its authority <br /> under this Ordinance. <br /> Section 6-4 . Powers of City Council. The City Council may bring <br /> suit in the Circuit Court to restrain, enjoin or otherwise <br /> -prevent the violation of this Ordinance. <br /> Section 6-5. Repeal. All ordinances and/or laws in conflict <br /> herewith are expressly repealed. <br /> Section 6-6 . . : Effective Date.
