• <br /> on an application pursuant to Section 2-3 (b) ( 1) -( 5) of this <br /> Ordinance, for inspecting any proposed, licensed or non-licensed <br /> establishment in order to ascertain whether it is in compliance <br /> with applicable criminal statutes and ordinance, and for <br /> enforcing applicable criminal statutes and ordinances, including <br /> those set forth at SECTION 5 of this Ordinance . In addition, the <br /> Police Chief is responsible for reviewing permit applications, as <br /> provided in SECTION 3. The Building Department is responsible <br /> for inspecting any proposed establishment for which a license is <br /> being applied for or any licensed establishment in order to <br /> ascertain whether it complies with or is complying with this <br /> Ordinance and all applicable building codes, statutes, <br /> ordinances, and regulations in effect in the City of Zephyrhills, <br /> Florida. The Fire Department is responsible for inspecting any <br /> proposed establishment for which a license is being applied for <br /> or any licensed establishment in order to ascertain whether it <br /> complies with or is complying with SECTION 4 of this Ordinance <br /> and all applicable fire codes, statutes, ordinances and <br /> regulations in Pasco County and the City of Zephyrhills. The <br /> Zoning and Permits Division of the Building Department is <br /> responsible for ascertaining whether a proposed establishment for <br /> which a license is being applied for complies with all locational <br /> requirements of this Ordinance, applicable portions of this <br /> Ordinance, all applicable zoning regulations in effect in the <br /> City of Zephyrhills, and whether a licensed establishment is <br /> complying with SECTION 5 of this Ordinance and all applicable <br /> zoning regulations and land use laws in effect in the City of <br /> Zephyrhills. The City Manager is responsible for granting, <br /> denying, renewing, cancelling, suspending, and revoking permits <br /> for proposed or current permittees in accordance with SECTION 3 <br /> of this Ordinance. <br /> Section 2-2. Adult Entertainment License Required: <br /> Classifications of. <br /> (a) Requirement. No adult entertainment establishment <br /> shall be permitted to operate without having been first granted <br /> an adult entertainment license by the City Manager under this <br /> Ordinance. <br /> (b) Classifications . Adult entertainment establishment <br /> licenses referred to in this Ordinance shall be classified as <br /> follows : <br /> ( 1) adult bookstore; <br /> (2 ) adult theater; and <br /> (3 ) adult dancing establishment. <br /> (c) Single Classification of License. Any adult <br /> entertainment license for a particular adult entertainment <br /> establishment shall be limited to one classification of license . <br /> Section 2-3. Application Required for Adult Entertainment <br /> License; Contents of; Application Fee; Rejection of Incomplete <br /> Application; Consent by Applicant. <br /> (a) Required. Any person desiring to operate an adult <br /> entertainment establishment shall file with the City Manager a <br /> sworn license application on a standard application form supplied <br /> by the City Manager. <br /> (b) Contents of Application. -The completed application <br /> shall contain the following information and shall be accompanied <br /> by the following documents: <br /> ( 1) if the applicant is : <br /> (A) an individual, the individual shall <br /> state his legal name and any aliases and submit satisfactory <br /> proof that he is eighteen ( 18) years of age; or <br /> -8- <br /> O.R. 2 ® 9 5 PQGE 1919 <br />
