<br /> . AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA,. ,RE_ZONIJG LANDS
<br /> WITHIN SAID CITY, PURSUANT TO THE REQUEST OF THEE' OWNERS OF- SUCH
<br /> LAND AND IN ACCORDANCE WITH FLORIDA STATUTE 166 .041 ( 3 ) (c) I..
<br /> WHEREAS, OAKLEY GROVES, INC. , a Florida Corporation, is the
<br /> owner in fee of the lands hereinafter described-in Section l,:and
<br /> WHEREAS, said OAKLEY GROVES, INC. , a Florida -Corporation has
<br /> applied for rezoning of said parcel from County AR to City C2,
<br /> and
<br />__ _ __ WHEREAS, the Planning Commission has recommended approval of
<br /> the owners application for rezoning, and
<br /> WHEREAS, the property to be rezoned does involve les-s-_-than
<br /> five percent ( 5%) of the total land area :of the City of
<br /> Zephyrhills and the City is thereby empowered to rezone-"same -in

<br /> accordance with Florida Statute 166 . 041 (3 ) (c) -1-1.(c) -1-1. '

<br /> NOW, THEREFORE, BE IT ENACTED AND ORDAINED' by - . the City
<br /> Council of the City of Zephyrhills, Florida, as follows:
<br /> SECTION 1. That the following described lands, lying and
<br /> . being situate in Pasco County,. Florida, to-wit:
<br /> Commencing at a point on the West right-of-way line of U.S.
<br /> Highway 301 at the intersection of the North boundary of Spanish
<br /> Trails Village, as recorded in Plat Book 13 , Pages 59 and 60,
<br /> Public Records of Pasco County, Florida, being in the SE i of
<br /> Section 34, Township 25 South, Range 21 East, thence. along the
<br /> North boundary of Spanish Trails Village, N-89°58 ',,4-0"---Wam, ,843 .32
<br /> feet, for a Point of Beginning; thence continue . N-89°58 '- .0"-W. ,
<br /> 300 . 00 feet, thence N-00°09 ' 28"-E. , 1300 .78--feet to the-, South
<br /> right-of-way line of Prett Pond Road, as : now located, -thence
<br /> along said line S-89 58 ' 35"-E. , 300.00 feet," thence
<br /> S-00 09 ' 28"-W. , 1300. 77 feet to the Point of --".Beginn-ing,
<br /> containing 8 .958 acres more or less.

<br /> SECTION 2 . This Ordinance shall become law upon being
<br /> passed by the City Council of the City of Zephyrhills after three
<br /> (3 ) read-ing-s--and- execution by the "presiding- cffic-, and the cl—a-r k--
<br /> of that body -in accordance with Florida Statute 166 .041, Laws of
<br /> Florida.
<br /> The foregoing Ordinance No. 540 was read and passed on
<br /> its first reading in open and regular meeting by the City Council
<br /> of the City of Zephyrhills, Florida on the a00- day of
