(PI akfciffoZP 1 9 els-o , il 4)S ORDINANCE NO. 465 AN EMERGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS , FLORIDA, PROVIDING THAT ANY IMPACT FEE IMPOSED UPON A DEVELOPER OR DEVELOPMENT WITHIN THE JURISDICTIONAL LIMITS OF THE CITY OF ZEPHYRHILLS BE SET AND ESTABLISHED BY THE CITY COUNCIL OF SAID CITY. WHEREAS , as a result of regional trends and recent public improvements , the City of Zephyrhills anticipates substantial growth and development within the upcoming years , and WHEREAS , the City Council of the City of Zephyrhills , Florida, has concluded that it is in the best interest of the City that this body reserve the right to set and establish any impact fee to be imposed upon development within the jurisdictional boundaries of the City of Zephyrhills , and WHEREAS , the City Council of the City of Zephyrhills , Florida, believes that it is in the best interest of the City that this Ordinance be passed on an emergency basis . NOW THEREFORE, BE IT ORDAINED as follows : IIISECTION ONE Title: This Ordinance shall be known as the "City of Zephyrhills Impact Fee Ordinance" . SECTION TWO Impact Fee: For purposes of this Ordinance, this term shall mean any fee charged a developer or development , . the proceeds of which are to be paid to the County of Pasco or the City of Zephyrhills to defray the costs of necessary improvements to governmental infrastructure necessitated by_the impact ,of such development ; and shall include, but is riot; limitedto, fees charged for construction or improvement of roads , " utility services , parks and recreation.
