A water shortage usually occurs due to drought . <br /> ( e) "Water Shortage Plan" means Chapter 40D-21 , <br /> 511:1 <br /> fl ' F1 &r lda ainist live Code, the codification of the Water <br /> Shortage Plan adopted and published by the Southwest Florida <br /> Water Management' 'District July, 1`983 . <br /> Section 2 . ' APPLICATION OF ORDINANCE . <br /> 2 . 01 The provisions of this ordinance shall apply to <br /> all persons using the water resource, whether from public or <br /> privately owned water utility systems , private wells , or <br /> private connections with surface water bodies . This <br /> ordinance shall not apply to persons using treated effluent <br /> or saltwater . <br /> Section 3 . DECLARATION OF WATER SHORTAGE : WATER <br /> SHORTAGE EMERGENCY <br /> 3 . 01 The declaration of a water shortage or water <br /> shortage emergency within all or any part of the City by the <br /> " ' GoFverehi ng 'B'oar-'d. or`! the Executive Director of the District <br /> shall invoke t`h`ey provisions of this Ordinance . Upon such <br /> declaration all water use restrictions or other measures <br /> adopted by the District pursuant to Chapter 40D-21 , Florida <br /> Administrative Code, applicable to the City or any portion <br /> thereof, shall be subject to enforcement action pursuant to <br /> Section 4. 01 of this Ordinance. Any violation of the <br /> provisions of Chapter 40D-21 , Florida Administrative Code, or <br /> any order issued pursuant thereto , shall be a violation of <br /> this Ordinance . <br /> Section 4. ENFORCEMENT. <br /> 4 .01 Every police officer or sheriff of the County or <br /> 111 Cities in the service areas governed by this Ordinance shall , <br /> in 'caWec` ion with all other duties imposed by law, <br /> " `difl 'igently enf'orc'e the provisions of this Ordinance . In <br /> addition , the City Manager may also delegate enforcement <br /> 0.R* 1415 PG 0536 <br />
