273 <br /> 27..Non-Conforming Use : A use, whether of land or of a struc- <br /> ture, which does not comply with the applicable use provi- <br /> sions or amendments of this Ordinance , 'where such use was <br /> lawfully in existence prior to the enactment of this Ordin- <br /> ance . <br /> 28 .Parking Space: An area of land at least nine (9) feet wide <br /> ' by twenty (20) feet long suitable for the temporary storage <br /> of a passenger vehicle . <br /> 29.Planned Unit Development: A commercial , professional, or <br /> residential project of three units or more constructed by <br /> a single owner or group of owners acting jointly .who pe- <br /> tition to develop in this fashion, involving a related group <br /> of uses planned, developed, and regulated as an entity. <br /> Such developments are compactly arranged individual or <br /> multi-unit buildings grouped in or around common open spaces <br /> together with public and semipublic uses or recreation fa- <br /> cilities , provided that they are functionally integrated <br /> so that the character of the development conforms to the <br /> purpose and intents of this Zoning Ordinance. Such devel- <br /> 00 opments shall include the necessary covenants or other legal <br /> (.9 provisions and financial programs as will assure conformity <br /> Q to the directives of the Comprehensive Plan. <br /> 30 .Plat: A scaled map, plan or layout of a subdivision indi- <br /> cating the location and boundaries of individual properties . <br /> 31 .Primary Building: See "Builging, Primary. " <br /> 32.Screen Planting: A vegetative material of sufficient height <br /> and density to conceal from the view of property owners in <br /> adjoining districts the structures or uses of the premises <br /> on which the screen planting is located. <br /> 33.Special Exception: The granting of a modification of the <br /> provisions of this Ordinance as authorized in specific in- <br /> stances listed, and under the terms , procedures and condi- <br /> tions prescribed herein. Special Exceptions are adminis- <br /> tered by the Board of Adjustment. <br /> 34.Street: A way over twenty (20) feet in width which is ded- <br /> icated to public use by legal mapping or any other lawful <br /> procedure and is accepted by the City. This includes any <br /> avenue, boulevard, court, lane , road, blighway or similar <br /> public ways which afford the prescribed means of principal <br /> access to an abutting lot. <br /> 35.Use: The specific purpose for which land or a biilding is <br /> designed, arranged, intended or for which it is or may be <br /> occupied or maintained. The term "permitted use" or its <br /> equivalent shall not include any non-conforming use . <br /> 36.Variance : The relief granted by the Board of Adjustment <br /> upon appeal in specific hardship cases from the terms of <br /> this Ordinance but within itssspirit and intent. <br /> 37.Yard: An open space on the same lot with a building, un- <br /> occupied and unobstructed from the ground upward, except <br /> as other wise provided herein. In measuring a yard for the <br /> purpose of determining a side yard, the depth of a front <br /> yard, or the depth of a rear yard, the minimum horizontial <br /> distance between the lot line and the main building shall <br /> be used. Covered porches , whether enclosed or unenclosed, <br /> and bay windows shall be considered as part of the ma=in <br /> building and shall not project into the required yard. <br /> �Fria I C37 PAGE 470 <br />
