<br /> WHEREAS, CWC Roofing � Exteriors (hereinafter "Undersigned") has been employed by Formula
<br /> Const►uction Group, LLC to furnish Roofing (describe materials, services, labor and equipment) under a contract,
<br /> subcontract, andlor purchase order for or in connection with the construction of improvements known as Village Walk
<br /> Apartments (hereinafter "Project"), which is located in the City of Zephyrhills, County of Pasco, State of FL
<br /> (hereinafter"Propert�')and is owned by Hallmark Village Walk,LLC (hereinafter°Owner°).
<br /> NOW, THEREFORE, the Undersigned, for itself, its employees, its subcontractors, sub-subcontractors,
<br /> mechanics, materialmen and laborers, does hereby:
<br /> (a) C��tiftC2tf1!�11:�of;"G�ad`1�Uork: Certify and warrant that the work performed to date is free from defects,
<br /> that fhe materials and equ'ipment furnished are of good quality and new, and that the work furnished
<br /> conforms to the requirements of the contract documents.
<br /> ro) INaiver°.o€Bond.Ri�hts. Waive, relinquish, and release any rights it has against any labor, material,
<br />� payment, performance, or lien discharge bond issued by Formula Construction Group, LLC and its
<br /> bonding companies. ,
<br /> (o) VUaider.of Lieri.f�iqhts. Waive, relinquish, and release any and all liens, claims of liens, or rights to
<br /> lien the foregoing described Property, through the Current Date. '
<br /> (d) IN�iuer ofi�Claims. Waive, relinquish, and release any and all claims, whether known or unknown,
<br /> against Formula Construction Group, LLC and its bonding companies and the Owner for labor,
<br /> services, material, and equipment furnished to or for the benefit of Formula Construction Group,
<br /> LLC or the construction project through the billing period for which its application is submitted or the
<br /> date of execution below,whichever is later("Current Date").
<br />� (e) Certfication-of Pavment,. Certify and warrant that all of its subcontractors, suppliers, mechanics,
<br /> materialmen, and-laborers,within the Undersigned's chain of contracts, have been paid and satisfied
<br /> in full for labor, services, material, and equipment furnished as of the Current Date.
<br /> (fl Scope. Acknowledge and agree that this instrumen# is an independent covenant and shall aperate
<br /> and be effective with respect to all labor and services provided and materials and equipment �
<br /> furnished by, through, or on behalf of the Undersigned regarding the Project or any supplemental �
<br /> contract or contracts,whether oral or written,for extra or additional work, and for any further labor or
<br /> services provided or materials or equipment furnished at any time with respect to the Project.
