M. , Dpty Clerk <br /> A RESOLUTION RELATING TO ZONING; APPROVING A, <br /> CONDITIONAL USE TO ALLOW AN INDOOR CLIMATIZED STORAGE ' <br /> U FACILITY TO BE LOCATED IN THE ZEPHYR COMMONS SHOPPING <br /> CENTER ON PROPERTY ZONED C2, COMMUNITY COMMERdAL; R <br /> FINDING CONFORMITY WITH THE COMPREHENSIVE PLAN;-AND nv <br /> PROVIDING AN EFFECTIVE DATE. <br /> WHEREAS, an application was filed by North American Development Group for a conditional <br /> use to allow an indoor climatized storage facility to be located in the Zephyr Commons shopping <br /> center on property zoned C2 with the parcel ID No. 35-25-21-0010-05600-0000, and <br /> WHEREAS,the subject property zoning is C2 (Community Commercial) and an indoor <br /> climatized storage facility is classified as a conditional use pursuant to the City's zoning <br /> ordinance, and consists of approximately 4.01 acres; and <br /> WHEREAS,the Site Plan Review Committee and Planning Commission recommended <br /> approval of the conditional use with the following conditions: <br /> 1. The holder of a conditional use permit shall be authorized to utilize the site or location <br /> of the use only in a manner specified in the written approval and conditions specified <br /> therein. Any substantial expansion, alteration or change in the conditional use <br /> authorized by the written approval must be reviewed by City Council in the same <br /> manner in which the original conditional use was reviewed. <br /> 2. An expansion, alteration or change of the conditional use shall be deemed to exist <br /> where a substantial modification in any of the standards provided for in the condition in <br /> number 1 above, results from activity associated with the conditional use or a <br /> substantial change of circumstances or conditions arise. <br /> 3. The conditions and stipulations shall become part of the written approval and must be <br /> informed to and followed by the applicant or any successor in interest. <br /> 4. The conditional use approval shall run with the ownership with the subject property. <br /> 5. The applicant shall obtain an approved site plan and any necessary permits from the <br /> Building Department and shall pay all related impact fees. <br /> 6. The applicant shall construct the storage facility with minimum architectural and design <br /> standards as reflected on the building renderings provided to City Council and attached <br /> hereto as Exhibit"A". <br /> NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF ZEPHYRHILLS, FLORIDA: <br /> Section 1. The foregoing findings are incorporated herein by reference and made a part hereof. <br /> Section 2. An indoor climatized storage facility on property more particularly described as <br /> located on property with the parcel ID No. 35-25-21-0010-05600-0000 is hereby approved. <br /> Section 3. The conditional use is approved for the benefit of the applicant only and for the use as <br /> specified within the application only, subject to the conditions herein. The character or benefit <br /> of this conditional use shall not be changed or transferred without City Council approval by <br /> resolution. <br /> Section 4.
