K., Dpty Clerk <br /> A RESOLUTION RELATING TO ZONING; APPROVING A <br /> CONDITIONAL USE TO ALLOW A DAYCARE CENTER ON PROPERTY <br /> ZONED C2, COMMUNI'�Y CO1VdIVIERCIAL; FINDWG CONFORMITY <br /> WTI'H TEIE COiVIPREHENSIVE PLAN; PROVIDING AN EF�ECTIVE <br /> DATE. <br /> � WHEREAS,an application was filed by Belkys Barrios for a conditional use to allow a 3aycare <br /> center o�ftto�erty witTi"tlie parcel ID No'3"4-25-21-4150-00000-OOl 4,and <br /> WHERE.�S,the subject property zoning is C2(Community Commercial)and a daycare center <br /> is classified as a conditional use pursuant to the City's zoning ordinance,and consists of <br /> approximately 4.35 acres;and <br /> WAEREAS,the Site Plan Review Committee and Planning Commission recommended <br /> approval of the conditional use witli the following conditions: <br /> 1. The holder of a conditional use permit shall meet all requirements of the State <br /> , Department of Children and Family for daycare centers and all additional requirements <br /> imposed by the City of Zephyrhills. <br /> 2. A crossing-guard shall be present on site at all pick-up and drop-offto ensure safe <br /> crossing of the frontage road. <br /> 3. Alterations to the interior and exterior of the building and site specific to the daycare <br /> center shall be depicted on a set of drawings to be submilted to and reviewed by the <br /> City. <br /> 4a.) The holder of a condirional use permit shall be authorized to utilize the site or location <br /> � of the use only in the manner specified in the written approval and condirions specified <br /> therein. Any substantial expansion,alteration or change in the conditional use <br /> authorized by the written approval must be reviewed by the City CounciL in the same <br /> manner in which the original conditional use�vas reviewed; <br /> 4b). An expansion,alteration or change of a conditional use shall be deemed to exist where <br /> a substantial modificarion results from activity associated with the conditional use or <br /> where a substantial change or circumstances or conditions arises; <br /> 4c). The conditions and stipulations shall become part of the written approval and must be <br /> conformed to and followed by the applicant or any successor in interest; <br /> 4d). The conditional use approval shall run with the lessee of subject property and; <br /> 4e). The applicant shall obtain any and all necessary licenses/permits from the State of <br /> Florida and the building department as well as a commercial business check from the <br /> building department. <br /> NOW THEREFOYtE,BE IT RESOLVED gY THE CITY COUNCIL OF THE <br /> CITY OF ZEPHYRHILLS,FLORIDA: <br /> � Section i, The foregoing findings are incorporated herein by reference and made a part hereof. <br /> Section 2. A daycare center on property more particularly described as located on property with <br /> the parcel ID No.34-25-21-0150-00000-0010 is hereby approved. <br /> Section 3. The conditional use is approved for the benefit of the applicani oniy and for the use as <br /> specified within the application only,subject to the conditions herein.
