<br /> AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF
<br /> ZEPHYRHILLS, FLORIDA AMENDING SECTION 93.02 OF THE
<br /> CODE OF ORDINANCES KNOWN AS THE ANIMAL CONTROL
<br /> ORDINANCE; PROVIDING FOR REPEALER, CODIFICATION
<br /> SEVERABILITY,AND AN EFFECTIVE DATE.
<br /> WHEREAS, the City Council has determined that it is in the City's interest to update the
<br /> City's Code of Ordinances from time to time to assure that the Code of Ordinances adequately
<br /> meet the needs of the City.
<br /> NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
<br /> Zephyrhills, Florida, as follows:
<br /> SECTION 1. Section 93.02 of the City of Zephyrhills, Code of Ordinances is hereby modified as
<br /> set forth herein:
<br /> a. Subsection "j." of Section 93.02 is hereby repealed in its entirety and replaced as
<br /> follows:
<br /> J. "domestic"(animals)shall mean those animals trained to live with and be of use to man;
<br /> tame and shall include domesticated dogs, cats, birds, fish rodents, rabbits and alike; but
<br /> shall not include cattle, horses, swine, potbellied pigs, sheep, goats or other grazing
<br /> animals, turkeys, poultry, foul, ostriches and llama or other animals normally raised for
<br /> food. Exception to this condition is to allow one mini pig (as defined by the American
<br /> Mini Pig Association)to be a permitted use as a domesticated pet per household in single-
<br /> family residential zones only. Mini pigs shall be required to be spayed or neutered and
<br /> have clean heath certificate from a veterinarian licensed in the State of Florida. Should such
<br /> pets become a nuisance and subject of residential complaints, code enforcement officers
<br /> shall be charged with requesting heath certificates and records indicating type or breed of
<br /> pig and spay or neutered documentation. Failure to provide such documents or comply
<br /> with these requirements shall result in a violation of this code and will result in the animal
<br /> being removed the property. _

<br /> SECTION 4. Repealer. OR BK 9789 PG 1373
<br /> All provisions of the City of Zephyrhills Code of Ordinances including but not limited to Section
<br /> 93.02,which are in conflict herewith are hereby repealed in their entirety.
<br /> SECTION 5. Codification.
<br /> It is the intent of the City Council that the provisions of this Ordinance be included as revisions
<br /> to existing Section 93.02 of the City of Zephyrhills Code of Ordinances.
<br /> SECTION 6. Severability.
<br /> In the event any section, paragraph, subsection, sentence, clause, phrase or word of this
<br /> Ordinance shall for any reason be held unconstitutional,invalid or ineffective,the same shall not
<br /> repeal, nullify or in any way affect any other section, paragraph, subsection, sentence, clause or
<br /> portion of this Ordinance,regardless of any other section,paragraph,subsection,sentence,clause
<br /> or portion thereof.
<br /> SECTION 7. Effective Date.
<br /> This Ordinance shall become effective upon passage on the second reading and signing by the
<br /> Mayor.
<br /> The Ordinance 1370-18 was read and passed on the first reading in an open and regular meeting
<br /> of the City Council of the City of Zephyrhills, Florida, on this 27th day of August, 2018.
