(g) Governing Law: This Agreement shall be governed by the,laws of the State of <br /> Florida,and any action brought to enforce the provisions.of this Agreement shall <br /> be subject to the jurisdiction of the Hillsborough County Circuit Court or the <br /> United States District Court for the Middle District of Florida-Tampa <br /> Division,for a federal district court proceeding. <br /> (h) Notices: Any notice required or permitted to be delivered under this Agreement <br /> shall be personally delivered or mailed by certified mail,return receipt requested, <br /> to the parties at the addresses set forth in the introductory paragraph of this <br /> Agreement and shalt be effective upon personal delivery or two (2) days after <br /> deposit of the notice with the United States Postal Service. <br /> (i) This Agreement incorporates by reference Exhibit`°A"(scope and payment),the <br /> document entitled Statutory Warnings and the Limited Workmanship Warranty. <br /> In the event of a conflict between those documents, this document controls and <br /> takes precedence. Owner acknowledges that it has received and reviewed all the <br /> documents referenced in the Agreement. <br /> (j) The losing party in any legal or equitable action arising out of or relating to this <br /> Agreement including appellate and/or bankruptcy proceedings shall reimburse the <br /> prevailing party on demand for all attorney's fees,costs,and expenses incurred by <br /> the prevailing party in connection with the action. <br /> (k) The person signing on behalfof Owner acknowledges that it has received the board <br /> and unit Owner's approval to the extent necessary; complied with all rules, <br /> regulations and laws governing this Contract; and that the person signing this <br /> Contract has the requisite authority to bind the Owner. <br /> (1) Owner agrees to provide Contractor with adequate access to electricity and other <br /> utilities as needed; the work site, and the work area adjacent to the structure. <br /> Contractor is not liable and Owner is solely liable for work installed by any person <br /> other than Contractor,unless otherwise specified by Contractor in this Agreement. <br /> (m) Due to the nature of the construction to be done at Owner's request,the Owner <br /> takes sole responsibility for any damage done to curbs, walkways, driveways, <br /> structures,septic tanks,sewer lines,water,gas or utility lines,arches,sod,shrubs, <br /> lawn, landscaping, trees, telephone or electric lines, HVAC, appurtenances, <br /> person(s)or real or personal property at the job location. <br /> (n) It shall be the sole obligation of the Owner to determine the existence of restrictions <br /> contained in deeds,subdivision or neighborhood regulations which might relate to <br /> or restrict the improvements under this Agreement. Contractor shall have no <br /> liability or responsibility for any such non-conformity with such restrictions or <br /> requirements. Contractor shall be entitled to payment from Owner of all sums due <br /> hereunder not withstanding any injunction/prohibition against the work as a result <br /> of any violation of such restrictiontrequirement. <br /> (o) Chapter 558 Notice of Claim.
