<br /> THiS AGREEMENT REGARD�NG AUTH RiZED BUILDER RIGHTS (this
<br /> "Authorization') is made.as of this day of , 201$, by and between
<br /> DUNE FL LAND I SUB LLC,.a Delaware limite liabii' company, whose address for
<br /> purposes hereof is 2502 North Rocky Point.Drive, Suite 1060,.Tampa, Florida 33607
<br /> (the "Declarant"), and LENNAR HOMES, LLC, a Florida limited liability company,-
<br /> whose address for purposes hereof is 4600 W. Cypress Street, Suite 200, Tampa,
<br /> Florida 33607 C&ennae), joined by the HIDDEN RIVER HOMEOWNERS
<br /> ASSOCIATION, INC., a Florida not for profit corporation (the"Association").
<br /> RECITALS
<br /> A: Pursuant to that certain Agreement for Purchase and Sale of Real
<br /> Property between Declarant, as "Seller," and Lennar, as "Buyer," dated April 11, 2017,
<br /> as may be subsequently amended (the "Agreement), Declarant will convey to Lennar
<br /> certain real property within the community known as "Hidden River," located in Pasco
<br /> County, Florida, which real property is legally described on Exhibit A attached hereto
<br /> and incorporated herein by this reference(the"Pro ert
<br /> B. Declarant recorded that certain Declaration of Covenants, Conditions and
<br /> Restrictions for Hidden River Homeowners Association, Inc., in OR Book 9551, Page
<br /> 3447, Public Records of Pasco County, Florida, as may be subsequently amended (the
<br /> "Declaration").
<br /> C. In connection with its ownership, development; marketing and sale of the
<br /> Lots, Lennar requested Declarant authorize Lennar to exercise certain rights under the
<br /> Declaration, and Declarant desires to so grant such authorization, with such
<br /> authorization being.binding upon the Declarant, Lennar and the Association, all subject
<br /> to the terms and conditions of this Authorization.
<br /> NOW, THEREFORE, for and in consideration of the sum of TEN DOLLARS
<br /> ($10.00) and other good and valuable consideration, the receipt of which 'is hereby
<br /> acknowledged, Declarant and Lennar hereby agree as follows:
