If Owner <br /> makes the progress payment during the five days following receipt of written notice, then such <br /> payment is deemed to cure any potential non-payment default. <br /> 9: If Contractor defaults in any provisions herein or fails to carry out the construction in <br /> accordance with the Contract Documents, Owner shall provide Contractor with written <br /> notice of the specific act or acts constituting such default. If Contractor fails to commence <br /> to correct such default within ton 10 days from receipt of such notice, Owner may <br /> terminate this contract before the termination date hcrcof.On such termination Owner may <br /> take possession of the work site and all material thereon and finish the work in whatever <br /> manner he deems expedient. <br /> 10. This agreement is binding on the parties hereto, their respective personal representatives, <br /> heirs,successors and assigns. <br /> 11. The Contractor is not responsible for any delays as a result of any act of God,material or <br /> labor shortages, as a result of transportation difficulties, delay in architectural or interior <br /> design plans, delay in finish selections or permitting pTrocessing.
