SPECIAL NOTICE — INSURANCE CHECKS- Neumann Construction & Roofing, LLC is agreeing to perform Work on the Property <br /> based solely upon Owners agreement to make payment for the Work performed, as set forth in this Repair Authorization. Owner <br /> hereby agrees to assign or endorse any and all payment received from Owner's Insurance Company directly to Neumann Construction <br /> &Roofing, LLC. Owner is responsible for any unpaid amounts,including any deductible owed. You are a trustee of any funds paid by <br /> the Insurance. <br /> Company for the whole Work performed on your Property. FLORIDA STATUTE 713,31, specifically states: "The name <br /> insured who receives any proceeds of the policy shall be deemed a trustee of the proceeds."Moreover,execution of this Repair <br /> Authorization gives Neumann Construction&Roofing, LLC joint ownership of the check(s)issued by the Owners Insurance Company <br /> for the work done under this Repair Authorization.This joint ownership exists regardless whether Neumann Construction & Roofing, <br /> LLC is co-payee of any check(s).Any negotiation of such check(s)without the express written permission of Neumann Construction& <br /> Roofing, LLC may be subject to criminal prosecution under FLORIDA STATUTE, 812.014. In the event that such check(s)exceed$300.00, <br /> the offense may be a grand theft felony, <br /> CHANGE ORDERS: There shall be no deductive change orders from the original scope or estimate of repairs exceeding the amount <br /> of the Insured's deductible.Any additive change orders shall require:(1)the written consent of Neumann Construction&Roofing,LLC <br /> actual <br /> and the Owner, and (2)any and all a ual cost(s)(including overhead and profit)associated with the performing the additional work. <br /> Any and all executed change orders shall be considered part of this Repair Authorization. Payment for change orders will be due as <br /> follows:50%upon acceptance of the change order and the entire balance due upon completion of the additional work. <br /> WARRANTIES PROVIDED BY NEUMANN CONSTRUCTION & ROOFING, LLC: Neumann Construction & Roofing, LLC hereby <br /> warrants and agrees to: (1)Perform all Work in a timely and workmanlike manner, in accordance with current Industry standards; (2) <br /> Provide workman's compensation and liability insurance to all personnel hired by Neumann Construction&Roofing,LLC; (3)Provide all <br /> standard industry warranties;and(4)Perform any warranty repair upon complete'and final payment of all amounts owed to Neumann <br /> Construction & Roofing, LLC. Neumann Construction & Roofing, LLC shall have no warranty obligation for any Work-performed <br /> hereunder if the entire amount due under this Repair Authorization is not paid in full within sixty (60) days of the last work was <br /> performed on the Property. <br /> SITE ACCESS: Neumann Construction & Roofing, LLC shall have full access to the Property to perform the Work every <br /> Monday through-Friday commencing at 8:00 a.m. and ending at 5:00 p.m. Owner shall remain responsible for Property security <br /> and safety unrelated to Neumann Construction&Roofing, LLC's Work, In the event the Owner requests Work be performed other than <br /> Monday through Friday commencing at 8:00 a.m. and ending at 5:00 p.m, Owner may be responsible for over time labor rates, as <br /> same may be applicable; <br /> DAMAGES: Any damaged property shall be compensable at actual cash value. Owner shall have no right to consequential damages <br /> related to the time of performance or schedule,or arising or related to the work itself. <br /> EXCEPTIONS I AMENDMENTS: <br /> ACCORDING TO FLORIDA'S CONSTRUCTION LIEN LAW (SECTIONS 713.001-713.37, FLORIDA STATUTES), THOSE WHO <br /> WORK ON YOUR PROPERTY OR PROVIDE MATERIALS AND SERVICES AND ARE NOT PAID IN FULL HAVE A RIGHT TO <br /> ENFORCE THEIR CLAIM FOR PAYMENT AGAINST YOUR PROPERTY. IF YOUR CONTRACTOR OR A SUBCONTRACTOR <br /> FAILS TO PAY SUBCONTRACTORS, SUB-SUBCONTRACTORS, OR MATERIAL SUPPLIERS, THOSE PEOPLE WHO ARE <br /> OWED MONEY MAY-LOOK TO YOUR PROPERTY FOR PAYMENT,EVEN IF YOU HAVE ALREADY PAID YOUR CONTRACTOR <br /> IN FULL.IF YOU FAIL TO PAY YOUR CONTRACTOR,YOUR CONTRACTOR MAY ALSO HAVE A LIEN ON YOUR PROPERTY. <br /> THIS MEANS IF A LIEN IS FILED YOUR PROPERTY COULD BE SOLD AGAINST YOUR WILL TO PAY FOR LABOR, <br /> MATERIALS, OR OTHER SERVICES THAT YOUR CONTRACTOR OR A.SUBCONTRACTOR MAY HAVE FAILED TO PAY. To <br /> PROTECT YOURSELF, YOU SHOULD STIPULATE IN THIS CONTRACT THAT BEFORE ANY PAYMENT IS MADE, YOUR <br /> CONTRACTOR 18 REQUIRED TO PROVIDE YOU WITH A'WRITTEN RELEASE OF LIEN.FROM ANY PERSON OR COMPANY <br /> THAT HAS PROVIDED TO YOU A "NOTICE TO OWNER." FLORIDA'S CONSTRUCTION LIEN LAW IS COMPLEX, AND IT IS <br /> RECOMMENDED THAT YOU CONSULT AN ATTORNEY. <br /> This Repair Authorization is intended to be a legally binding contract between all patties,their successors and/or assigns.
