i <br /> F• <br /> (41)Stealth Design means a method of camouflaging any tower,Antenna, Wireless Facilities, <br /> or other ancillary supporting communications facility, including, but not limited to, <br /> supporting electrical, optical, or mechanical, or ther equipment, which enhances <br /> compatibility with adjacent land uses and which is visu 11y and aurally unobtrusive. Stealth <br /> design may include a repurposed structure. Stealt design includes any method of <br /> camouflaging Wireless Facilities adopted by the City Council through resolution <br /> (42) Utility Pole means a pole or similar structure us d in whole or in part to provide <br /> communications services or for electric distribution, lighting, traffic control, signage, or a <br /> similar function. The term includes the vertical suppo structure for traffic lights,but does <br /> not include any horizontal structures upon which are attached signal lights or other traffic <br /> control devices and does not include any pole or similar structure 15 feet in height or less <br /> unless the City grants a waiver for the pole. <br /> (43) Video Programming means programming provided by, or generally considered <br /> comparable to programming provided by, a television broadcast station as set forth in 47 <br /> U.S.C. §522(20). <br /> (44) Video Service means video programming services, including cable services, provided <br /> through wireline facilities located at least in part in the Public Rights-of-Way without <br /> regard to delivery technology,including internet protocol technology. This definition does <br /> not include any video programming provided by a commercial mobile service provider as <br /> defined in 47 U.S.C. §332(d),video programming pro1ided as part of and via a service that <br /> enables end users to access content, information, elect onic mail, or other services offered <br /> over the public internet. <br /> (45) Video Service Provider means an entity providing video service. <br /> (46) Wireless Facilities means equipment at a fixed location which enables wireless <br /> communications between user equipment and a communications network, including radio <br /> transceivers, Antennas, wires, coaxial or fiber-optic cable or other cables, regular and <br /> backup power supplies, and comparable equipment, regardless of technological <br /> configuration, and equipment associated with wireless communications.The term includes <br /> Small Wireless Facilities. The term does not include(a)the structure or improvements on, <br /> under, within, or adjacent to the structure on which he equipment is Collocated, or (b) <br /> wireline backhaul facilities, or (c) coaxial or fiber-o tic cable that is between wireless <br /> structures or Utility Poles or that is otherwise not ' ediately adjacent to or directly <br /> associated with a particular Antenna. <br /> (47) Wireless Infrastructure Provider means a person ho has been certified to provide <br /> telecommunications service in the state, and who builds or installs wireless communication <br /> transmission equipment, Wireless Facilities, or Wire ess Support Structures, but is not a <br /> Wireless Services Provider. <br /> (48) Wireless Provider means a Wireless Infrastructur Provider or a Wireless Services <br /> Provider. <br /> (49) Wireless Services means any services provided using licensed or unlicensed spectrum, <br /> whether at a fixed location or mobile, using Wireless Facilities. <br /> (50) Wireless Services Provider means a person who provides Wireless Services. <br /> (51) Wireless Support Structure means a freestanding structure, such as a monopole, a guyed <br /> or self-supporting tower, or another existing or proposed structure designed to support or <br /> capable of supporting Wireless Facilities. The term d es not include a Utility Pole. <br /> 7.12.04. -Registration. <br /> 7.12.04.01 Every Communications Services Provider that desires to place or maintain ' <br /> a Communications System or any Communications Facilities in the Public Rights-of-Way, <br /> including any Pass-Through Facilities, shall first Register(with the City in accordance with this <br /> section.
