Registration does not a cuse a Communications Services <br /> Provider from complying with all other applicable City ordinances, codes or regulations, <br /> including the rules, regulations and general conditions set forth in this Part. <br /> 7.12.04.05 A Communications Services Provider, may cancel a Registration upon <br /> written notice to the City stating that it will no longer place or maintain a Communications <br /> System or any Communications Facilities in the Public Rights-of-Way and will no longer have <br /> a need to apply for Right-of-Way Use Permits to perfor. construction or other work in the <br /> Public Rights-of-Way. A Communications Services Provii er may not cancel a Registration if <br /> it intends to continue placing or maintaining a Communications System or any <br /> Communications Facilities in the Public Rights-of-Way. <br /> 7.12.04.06 Registration, in and of itself, does not establish a right to place or maintain <br /> or a priority for the placement or maintenance of a Communications System or any Facility in <br /> the Public Rights-of-Way,but shall establish for the Communications Services Provider a right <br /> to apply for a Right-of-Way Use Permit from the City. Riegistrations are expressly subject to <br /> any future amendment to or replacement of this Part and further subject to any additional City <br /> ordinances, as well as any state or federal laws that ma' be enacted. Registration does not <br /> excuse or exempt a Communications Services Provider from having to obtain a Business Tax <br /> Receipt from the City and pay the City's Business Tax in accordance with the City Code. <br /> 7.12.04.07 A Communications Services Provider ¶hall renew its Registration with the <br /> City by April 1 of even numbered years in accordance with the Registration requirements in <br /> this Part, except that any Communications Services Provider that initially Registers during the <br /> even numbered year when renewal would be due or tle odd numbered year immediately <br /> preceding such even numbered year shall not be required to renew its Registration until the <br /> next even numbered year. Within 30 days of any change in the information required to be <br /> submitted pursuant to subsection 7.12.04.02, a Communications Services Provider shall <br /> provide updated information to the City. If no information in the then-existing Registration has <br /> changed, the renewal may state that no information has changed. Failure:to renew a <br /> Registration may result in the City restricting the issuai ce of additional Right-of-Way use <br /> permits until the Communications Services Provider has complied with the Registration <br /> requirements of this Part. <br /> 7.12.04.08 In accordance with applicable City ordinances, codes or regulations, a <br /> Right-of-Way Use Permit is required for a Communications Services Provider to place or <br /> maintain a Communications Facility in the Public Right- of-Way. An effective Registration <br /> shall be a condition of obtaining such a permit. Notwithstanding an effective Registration, all <br /> permitting requirements shall apply, including the requirement to pay for any such permits <br /> unless otherwise provided by resolution or ordinance of t e City.A permit may be obtained by <br /> or on behalf of the Communications Services Provider h ving an effective Registration if all <br /> permitting requirements of the City and other provisions f this Part are met. <br /> 7.12.04.09 A Reseller,which by definition does not place or maintain Communications <br /> Facilities in the Public Rights-of-Way, is not required to Register with the City. <br /> 7.12.05. -Notice of Transfer, Sale or Assignment of Asset . <br /> If a Communications Services Provider transfers, ells or assigns its System or any <br /> Facilities located in the Public Rights-of-Way incident to a transfer, sale or assignment of the <br /> Communications Services Provider's assets,the transferee,b yer or assignee shall be obligated to <br /> comply with the provisions set forth in this Part. Writtenotice of any such transfer, sale or <br /> assignment shall be provided by the Communications Service Provider to the City within 30 days <br /> after the effective date of such transfer, sale or assignment. If the transferee, buyer or assignee is <br /> not currently registered with the City, then the transferee, buyer or assignee shall Register as <br /> provided in Section 7.12.04 within 60 days of the effective date of such transfer, sale or <br /> assignment. If any Applications for Right-of-Way Use Permits are pending under the <br /> Communications Services Provider's name as of the date th City receives written notice of the <br /> transfer, sale or assignment,then the City shall consider the t ansferee,buyer or assignee as a new <br /> Applicant unless otherwise notified by the Communications Services Provider. <br /> Page 9 of 31 <br />
