<br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
<br /> ZEPHYRHLLLS,FLORIDA VACATION OF RIGHT-OF-WAY FOR CBD
<br /> REAL ESTATE,LLC. •
<br /> WHEREAS,pursuant to Section 7.03.02.03 of-the City of Zephyrhills Land Development Code, •
<br /> Vacation of Right-of-Ways,
<br /> •
<br /> t'- WHEREAS, the City Council finds that the requested vacation is consistent with the Traffic
<br /> Circulation Element of the City of Zephyrhills Comprehensive Plan;
<br /> WHEREAS,the City Council finds that the right-of-way does not provide the sole access to any
<br /> prePerty;
<br /> WHEREAS, the City Council finds that vacation would not jeopardize the current or future
<br /> location of any utility;
<br /> WHEREAS,the City Council finds that the vacation is not detrimental to the public interest,and
<br /> provides a positive benefit to the City of Zephyrhills.
<br /> NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
<br /> ZEPHYRHILLS,FLORIDA:
<br /> Section 1. That the City Council of the City of Zephyrhills hereby vacates the
<br /> following Right-of-Way:
<br /> LEGAL DESCRIPTION:
<br /> • A 15 foot wide strip of land being a portion of the North 15 feet of the Southeast 1/4
<br /> of the Southwest 1/4 of Section 4, Township 126 South; Range 21 East, Pasco County,
<br /> Florida, being more particularly described as follows:
<br /> COMMENCE at the Northwest corner of the Southeast 1/4 of the Southwest 1/4 of
<br /> Section 4. Township 26 South, Range 21 East, PascoCounty, Florida, some being an
<br /> • East corner of Tract A. according to the plot of SILVERADO PHASE 1A, as recorded in
<br /> Plat Book 61, Page 71, of the Public Records of Pasco County, Florida; thence
<br /> N89'47'56"E, along the North line of said Southeast 1/4 of the Southwest 1/4 of
<br /> Section 4, same being the East line of said Tract 'A". for 15.01 feet to an East corner
<br /> of said Tract A, some being the POINT OF BEGINNING; thence leaving said East line of
<br /> Tract 'A", continue N89'4756'1, along said North line of the Southeast 1/4 of the -
<br /> Southwest 1/4 of Section 4, same being the North line of a 15 foot, unnamed
<br /> Right—of—Way, according to the plat of ZEPHYRHILLS COLONY COMPANY, as recorded in •
<br /> Plat Book 1, Page 55, of the Public Records of Pasco County, Florida, for 1,325.53 feet
<br /> thence leaving said North line of the Southeast 1/4 of the Southwest 1/4 of Section 4,
<br /> some being said North line of a 15 foot, unnamed Right—of—Way, S0219'21"W, for 15.01
<br /> feet to the point of Intersection with the South line of said 15 foot. unnamed
<br /> Right—of—Way, same being a point on the West Right—of—Way line of DEAN DAIRY ROAD, •
<br /> same also being the Northeast corner of Tract 101, both according to said plat of
<br /> ZEPHYRHILLS COLONY COMPANY; thence leaving said West Right—of—Way line of DEAN
<br /> DAIRY ROAD. S89'47'56"W, along said South line of a 15 foot. unnamed Right—of—Way,
<br /> the North line of said Tract 101 and the North line of Tract 102, according to said plat
<br /> of ZEPHYRHILLS COLONY COMPANY, respectively, for 11,325.41 feet to the Northwest
<br /> ('. ', corner of said Tract 102, some being the point of intersection with said East'line of
<br /> I: ': Tract NA", according to said Plat of SILVERADO PHASE 1A; thence leaving said South line
<br /> of a 15 foot, unnamed Right—of—Way, NO1'51'37'E, along said East line of Tract 'A't for
<br /> 15.01 feet to the POINT OF BEGINNING.

<br /> Containing 19,882 square feet or 0.456 acres, more or less.
<br /> Section 2. That is Resolution shall take effect immediately upon its adoption.

<br /> NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Zephyrhills,
<br /> Florida sitting in regular session this 11t day of January,2021.•
