Applicant shall notice prospective owners of proximity to airport through, at a minimum, the HOA deed restrictions and covenants. Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 5. That if any section, sentence, clause, or phrase of this ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. Section 6. This Ordinance shall become effective, if the amendment is not timely challenged (after transmittal upon its passage of the first reading), thirty-one (3 1) days after the State Land Planning Agency notifies the City that the adopted plan amendment package is complete. If timely challenged, this amendment shall become effective on the date the State Land Planning Agency or Administration Commission enters a final order determining this Amendment to be in compliance.
