<br /> 4. Amounts unpaid after thirty(30)calendar days shall bear interest at the rate of eighteen percent(18%)per year.Purchaser shall reimburse Seller for all
<br /> costs incurred,including attorneys'fees,occasioned by Purchasers default under any terms of the Contract Documents.
<br /> 6. Purchaser is obligated to pay the Contract Sum as described herein regardless of any financing terms in place.
<br /> 6. Contract Documents.This Contract consists of this document,Change Orders,extra work/wood authorizations,If any,and all financing documents,if
<br /> any.No promises other than those specifically set forth in the Contract Documents shall be recognized by either party.The entire understanding and
<br /> agreement of the parties is contained in the Contract Documents. 1L

<br /> 7. Wort ascribed in the Contract Documents will commence in approximately V-' and be completed in approximately
<br /> .The recited dates are approximations and are subject to scheduling difficulties of Seller,labor and/or material shortages,acts of God
<br /> and other evens not foreseen by Seller.
<br /> 8. Seller shall provide a lifetime warranty on its workmanship. This warranty does not apply to workmanship or materials not paid in full.Seller does not
<br /> warrant any materials,equipment,fixtures,packaged products or specialty windows if the same comes with a manufacturer's warranty,rather,Purchaser
<br /> shall rely solely on manufacturers'warranties.Seller's warranty excludes remedy for damage or defects caused by abuse,modifications not executed by
<br /> Seller,vandalism,wind,natural disasters or perils,war,improper or insufficient maintenance,improper operation,or normal wear and tear.If Purchaser fails
<br /> to notify Seller and give Seller an opportunity to make corrections,Purchaser waives its right to make a claim for breach of warranty.Liability under any
<br /> warranty by Seller is limited to the replacement of the work or materials only and shall not apply to any alleged consequential or other claimed resulting
<br /> damages flowing therefrom.THIS WARRANTY IS IN LIEU OF ANY OTHER WARRANTIES,EXPRESS OR IMPLIED,AS TO MERCHANTABILITY,
<br /> FITNESS FOR A PARTICULAR PURPOSE,OR ANY OTHER END PURPOSE OR USE AND THERE ARE NO WARRANTIES THAT EXTEND BEYOND
<br /> THE DESCRIPTION ON THE FACE HEREIN.
<br /> 9. Price Escalation-The Contact Sum is based upon material and labor costs in effect at the time of execution of this Contract.In the event that the
<br /> process or completion of the Work is delayed by any act of the Purchaser which is not the fault of Seller,or by a force majeure event,to the extent that the
<br /> cost of material or labor or both are increased beyond those upon which this Contract Sum is based,the amount of such increased costs shall be added to
<br /> the Contract Sum.
<br /> 10. Seller shall not be liable for any consequential,secondary,incidental,special,indirect or punitive damages of any kind,whether in contract,tort,
<br /> Including negligence,warranty,or otherwise.
<br /> 11. The parties agree that this Contract shall be governed by the laws of the Stale of Florida,and any action brought in thereon shall be brought in the State
<br /> of Florida.Venue Is hereby agreed to be in Hillsborough County,Florida.The prevailing parry In any dispute between Seller and Purchaser arising out of or
<br /> relating to the work shall be entitled to recover from the non-prevailing party all of its reasonable attorneys'and paralegals'fees,costs,including all costs not
<br /> taxable as costs,In any litigation and any related appeals.
<br /> 12. Both worker's compensation and public liability insurance are carried by the Seller and they are applicable to the work to be performed.
<br /> 13. The undersigned warrant(s)that he is(they are)the owner(s)of the above-mentioned premises and the legal title thereto stands of record in his(their)
<br /> name(s).
<br /> 14. Contract price includes all coupons and/or discounts.
<br /> 16. PURCHASER'S RIGHT TO CANCEL.This is a home solicitation sale,and if you do not want the goods or services,you may cancel this Contract by
<br /> providing written notice to the Seller in person or mail.This notice must indicate that you do not want the goods or services and must be delivered or
<br /> postmarked before midnight of the third business day after you sign this Contract.
