RESIDENTIAL SWIMMING POOL, SPA, AND/OR HOT TUB SAFETY ACT
<br /> NOTICE OF REQUIREMENTS
<br /> I (We) acknowledge that a new swimming pool, spa, or hot tub will be constructed or installed at (please print street
<br /> address) nU21 w0oigit F1, 335 LI2— and hereby affirm that one of the
<br /> following methods will be used to meet ter uirements of Florida Statutes (F.S.) 515:
<br /> Please initial the method(s)to be used for your pool.
<br /> _ The pool will be isolated from access to the home by an enclosure that meets the pool barrier requirements of
<br /> F.S. 515.29.
<br /> The pool will be equipped with an approved, safety-pool cover that complies with ASTM F1346-91 (Standard
<br /> Performance Specifications for Safety Covers for Swimming Pools, Spas, and Hot Tubs).
<br /> All doors and windows providing direct access from the home to the pool and located within the
<br /> enclosure/fence required by the Pasco-County Land Development Code (LDC), Section 530.4(D), will be
<br /> equipped with an exit alarm that has a minimum sound pressure rating of 85 decibels at ten feet.
<br /> All doors providing direct access from the home to the pool and located within the enclosure/fence required by
<br /> the Pasco County LDC, Section 530.4(D),will be equipped with self-closing, self-latching devices with release
<br /> mechanisms placed no lower than 54 inches above the floor or deck.
<br /> In addition to the enclosure/fence required by the Pasco County LDC, Section 530.4 (D), a swimming pool
<br /> alarm that,when placed in a pool, sounds an alarm upon detection of an accidental or unauthorized entrance
<br /> into the water. Such pool alarm must meet and be independently certified to ASTM Standard F2208, titled
<br /> "Standard Safety Specification for Residential Pool Alarms," which includes surface motion, pressure, sonar,
<br /> laser, and infrared alarms. For purposes of this paragraph, the term "swimming pool alarm" does not include
<br /> any swimming protection alarm device designed for individual use, such as an alarm attached to a child that
<br /> sounds when the child exceeds a certain distance or becomes submerged in water.
<br /> I UNDERSTAND AND AGREE THAT NOT HAVING AT LEAST ONE OF THE ABOVE INSTALLED AT THE TIME OF
<br /> FINAL INSPECTION OR WHEN THE POOL IS COMPLETED FOR CONTRACT PURPOSES WILL CONSTITUTE A
<br /> VIOLATION OF F.S. 515, AND WILL BE CONSIDERED AS COMMITTING A MISDEMEANOR OF THE SECOND
<br /> DEGREE, PUNISHABLE BY FINES UP TO $500.00 AND/OR UP TO 60 DAYS IN JAIL AS ESTABLISHED IN F.S. 775.
<br /> R4501.17.1.10: Where an aboveground pool structure is used as a barrier or where the barrier is mounted on top of the
<br /> pool structure and the means of access is a ladder or steps, the ladder or steps shall either be capable of being secure,
<br /> locked, or removed to prevent access, or the ladder or steps shall be surrounded by a barrier which meets the
<br /> requirements of R4501.17.1.1 through R4501.17.19 and R4501.17.12 through R4501.17.14. When the ladder or steps
<br /> are secured, locked, or removed, any opening created shall not allow the passage of a four-inch diameter sphere.
<br /> I FURTHER UNDERSTAND AND AGREE THAT THE OWNER AND/OR CONTRACTOR WILL COMPLY WITH THE
<br /> FOLLOWING REGULATIONS CONCERNING SWIMMING POOL, SPA, AND/OR HOT TUB ENCLOSURES
<br /> IMMEDIATELY UPON COMPLETION OF THE SWIMMING POOL, SPA, OR HOT TUB, IN COMPLIANCE WITH THE
<br /> PASCO COUNTY LDC, SECTION 530.4(D):
<br /> 1. Construct around the swimming pool, spa, or hot tub a MINIMUM FOUR-FOOT-HIGH FENCE with self-closing,
<br /> self-latching gates. The fence must not have any gaps, openings, indentations, protrusions, or structural
<br /> components that could allow a young child to crawl under, squeeze through, or climb over the fence. Gates must
<br /> open outward, away from the pool area. The releasing mechanism of the latching device must be located on the
<br /> pool side of the gate and so placed that it cannot be reached by a young child over the top or through any
<br /> opening or gap. No opening in the fence may be large enough to admit a four-inch sphere.
<br /> 2. Construct a screen enclosure around the swimming pool, spa, or hot tub with self-closing, self-latching, screen
<br /> doors. Latches on exterior, screen doors must be a minimum of 54 inches from the exterior access standing
<br /> surface. All screen enclosures require Building Permits.
