RESOLUTION NO. 795-22 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />ZEPHYRHILLS, FLORIDA, AMENDING EXHIBIT "A", OF <br />RESOLUTION NO. 522-03 AND RESOLUTION 737-17 REGARDING <br />THE ESTABLISHMENT OF WATER AND WASTEWATER <br />FACILITIES CAPACITY FEES AND PROVIDING FOR REPEALER <br />AND AN EFFECTIVE DATE. <br />WHEREAS, the City Council is empowered, pursuant to Ordinance No.: 818-02 and <br />Ordinance No.: 813-02 to establish, impose and collect capacity fees on the new connections to <br />the utility system, so as such new connections contribute a pro-rata share to the cost of the <br />system capacity and facilities needed to serve for all new connections; and <br />WHEREAS, the City Council of the City of Zephyrhills, Florida, has reviewed the <br />Water and Wastewater Rate and Impact Fee Study prepared at its request; and <br />WHEREAS, the City Council of the City of Zephyrhills, Florida, has determined the <br />City ofZephyrhills' Utility System Water and Wastewater Facilities Capacity Fees no longer <br />adequately provide for the needs of the City; and <br />WHEREAS, the new fee amounts as amended herein imposed shall apply to new <br />connections, as well as a redevelopment or upgrade of a project that will increase the water <br />or wastewater system ; and <br />NOW. THEREFORE. BE IT RESOLVED by the City Council of the City of <br />Zephyrhills, Florida, as follows; <br />Section 1. Exhibit "A", Water and Wastewater Facilities Capacity Fees of Resolution <br />No. 522-03 and Resolution No. 737-17 are deleted in their entirety and substantially <br />rewritten as attached. <br />Section 2. The Water and Wastewater facilities Capacity Fees as set forth in Exhibit <br />"A", shall become effective on October 1, 2022. The Equivalent Dwelling Units Table as set <br />forth in Exhibit "B", is ratified upon adoption of this Rate Resolution. Furthermore, The State <br />of Florida Department of Health, Chapter 64E-6, Florida Administrative Rules, Standards for <br />Onsite Sewage Treatment and Disposal Systems shall be likewise ratified upon adoption of <br />this Resolution. <br />Sections. Re ealer. All resolutions in conflict herewith are hereby repealed to the <br />extent of any conflict. All other terms and provisions of Resolution No. 522-03 and Resolution <br />No. 737-17 that are unaffected by this Resolution shall remain in full force and effect. <br />Section 4. Effective Date. The provisions of this Resolution shall become effective
