RESOLUTION NO.: 793-22 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />ZEPHYRHILLS, FLORIDA, ESTABLISHING A CHARTER <br />REVIEW COMMITTEE; ESTABLISHING A LIMITED PERIOD <br />OF EXISTENCE; MEMBERSHIP; PROVIDING A STATEMENT <br />OF DIRECTION; SETTING A FINAL COMMITTEE REPORT <br />DATE; PROVIDING FOR REVIEW OF THE FINAL <br />COMMITTEE REPORT AND A DECISION BY CITY COUNCIL <br />ON WHAT RECOMMENDATIONS TO PLACE BEFORE THE <br />VOTERS IN A REFERENDUM; AND PROVIDING FOR AN <br />EFFECTIVE DATE. <br />WHEREAS, an initial review of the City Charter by the City Council and City staff revealed <br />that many provisions of the Charter had been repealed or needed updated, and that other sections <br />were outdated or in conflict with City ordinances; and <br />WHEREAS, the City Council desires to initiate a further review of the Charter by an appointed, <br />temporary committee of City Council members to recommend what, if any, changes or <br />amendments should be made to the Charter so that it will continue to meet the City's needs as the <br />City's primary governing document and will not be in conflict with existing City ordinances; and <br />WHEREAS, the City Council desires that the review of the Charter shall be accomplished <br />within a reasonable time frame and shall be guided by the principles, purposes and directives set <br />forth herein. <br />NOW THEREFORE BE IT RESOLVED by the City Council of the City of Zephyrhills, <br />Florida, in regular session duly assembled, as follows: <br />Section 1. Charter Review Committee Established. The City Council hereby <br />establishes a Charter Review Committee (the "Committee") to review and make <br />recommendations to the Council regarding changes and amendments to the City Charter. The <br />Committee shall be wholly advisory in nature. <br />Section 2. Term of Existence. The Committee shall exist from the date of this <br />resolution and continue for a period not to exceed three hundred sixty-five (365) days therefrom <br />or the date on which it tenders its Final Report to the City Council, whichever first occurs, unless <br />otherwise extended by further resolution of the City Council. <br />Section 3. Membershi . The Committee shall consist of the Mayor plus all five (5) <br />City Council members. <br />Section 4. Committee Chair* Meetin s & Procedure. The Chairperson of the <br />Committee shall be selected by the members thereof at the initial meeting of the Committee. The <br />City Manager shall notify the members of the initial meeting which shall be held no later than <br />thirty (30) days from the date of adoption of this resolution. Thereafter, all subsequent meeting <br />dates of the Committee, its additional officers, meeting procedures, operational bylaws and other <br />methods of operation shall be adopted as a majority of the Committee sees fit, consistent with <br />Section 286.011, Florida Statutes and Florida's Sunshine Law. <br />Section 5. Statement of Committee Direction. The Committee is directed to <br />undertake a complete, timely, and thorough review of the City Charter. They are specifically <br />directed to receive public input from City residents and the Committee's members as to changes <br />and amendments that will allow the City's government to function efficiently, effectively and in <br />the best interests of its citizens. In addition, they are directed to schedule quarterly public <br />workshops with the City Council to update the Council on their progress and to provide <br />completed reviews to the Council for their consideration. <br />Particular attention should be paid to providing a document that is both consistent with the City's <br />current ordinances and that will enable the City's governing body and administrators to meet the <br />needs of the citizens well into the new millennium.
