INSTR# 2022146520 OR BK 10645 PG 3607 Page 1 of 3 07/05/2022 10:19 AM Rcpt: 2475786 Rec: 27.00 DS: 0.00 IT: 0.00 Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller ORDINANCE NO. 1438-22 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA APPROVING A ZONING DESIGNATION CHANGE FROM PUD (PLANNED UNIT DEVELOPMENT) TO C2 (COMMUNITY COMMERCIAL) FOR APPROXIMATELY 0.73 ACRES OF REAL PROPERTY HAVING THE PAROLE NO. 26-25-21-0130-00000-0130; PROVIDING FOR CODIFICATION, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, Chapters 166 and 163, Florida Statutes, authorize the City Council of the City of Zephyrhills to rezone property within the City limits upon written consent of the landowner, together with the approval of the City Council of said rezoning duly expressed by Ordinance; and WHEREAS, SF Zephyr Commons Outparcels, as owner of the lands described in Section 2 below, consented to Rezoning by the City of Zephyrhills of said lands described in Section 2 below; and WHERAS, due public notice of hearing on the proposed rezoning was given by the City Council on June 2, 2022, as required by the Zephyrhills Land Development Code, as amended, and Chapters 163 and 166, Florida Statutes; and WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold public hearing on the 19th day of May, 2022 to consider said proposed rezoning and recommended approval; and WHEREAS, the City Council has determined that the C2 (Community Commercial) Zoning designation would be appropriate, would promote the general welfare, and would encourage proper development within the City; and WHEREAS, the City Council desires to hereby formally adopt the amendment to the City's Official Zoning Map. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows: Section 1: The Whereas Clauses above are true and accurate and are incorporated by reference and made a part of this Ordinance. Section 2: The following lands, lying and being situated in Pasco County, Florida to -wit: See Exhibit "A" Pareel/Tax ID No.: 26-25-21-0130-00000-0130 Physical Address: No Address Assigned Legal Description: ZEPHYR COMMONS PHASE 1 PB 65 PG 132 LOT 13 OR 254 PG 1646 Acreage: 0.73 Acres (MOL) The Zoning designation is hereby changed from City PUD to City C2 and is included within the boundaries of the City of Zephyrhills, Florida. Section 3: This Ordinance is enacted pursuant to Chapter 163, Florida Statutes, and under the home rule powers of the City. Section 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 5: That if any section, sentence, clause or phrase of this Ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no way effect the validity of the remaining portions of this ordinance. Section 6: This Ordinance shall become effect upon passage on the second reading and signing by the Mayor. -1-
