INSTR# 2022146520 OR BK 10645 PG 3607 Page 1 of 3 <br />07/05/2022 10:19 AM Rcpt: 2475786 Rec: 27.00 DS: 0.00 IT: 0.00 <br />Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller <br />ORDINANCE NO. 1438-22 <br />AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, <br />FLORIDA APPROVING A ZONING DESIGNATION <br />CHANGE FROM PUD (PLANNED UNIT DEVELOPMENT) <br />TO C2 (COMMUNITY COMMERCIAL) FOR <br />APPROXIMATELY 0.73 ACRES OF REAL PROPERTY <br />HAVING THE PAROLE NO. 26-25-21-0130-00000-0130; <br />PROVIDING FOR CODIFICATION, SEVERABILITY AND <br />AN EFFECTIVE DATE. <br />WHEREAS, Chapters 166 and 163, Florida Statutes, authorize the City Council of the City of <br />Zephyrhills to rezone property within the City limits upon written consent of the landowner, <br />together with the approval of the City Council of said rezoning duly expressed by Ordinance; and <br />WHEREAS, SF Zephyr Commons Outparcels, as owner of the lands described in Section 2 below, <br />consented to Rezoning by the City of Zephyrhills of said lands described in Section 2 below; and <br />WHERAS, due public notice of hearing on the proposed rezoning was given by the City Council <br />on June 2, 2022, as required by the Zephyrhills Land Development Code, as amended, and <br />Chapters 163 and 166, Florida Statutes; and <br />WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold public <br />hearing on the 19th day of May, 2022 to consider said proposed rezoning and recommended <br />approval; and <br />WHEREAS, the City Council has determined that the C2 (Community Commercial) Zoning <br />designation would be appropriate, would promote the general welfare, and would encourage <br />proper development within the City; and <br />WHEREAS, the City Council desires to hereby formally adopt the amendment to the City's <br />Official Zoning Map. <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, <br />Florida, as follows: <br />Section 1: The Whereas Clauses above are true and accurate and are incorporated by reference <br />and made a part of this Ordinance. <br />Section 2: The following lands, lying and being situated in Pasco County, Florida to -wit: <br />See Exhibit "A" <br />Pareel/Tax ID No.: 26-25-21-0130-00000-0130 <br />Physical Address: No Address Assigned <br />Legal Description: <br />ZEPHYR COMMONS PHASE 1 PB 65 PG 132 LOT 13 OR 254 PG 1646 <br />Acreage: 0.73 Acres (MOL) <br />The Zoning designation is hereby changed from City PUD to City C2 and is <br />included within the boundaries of the City of Zephyrhills, Florida. <br />Section 3: This Ordinance is enacted pursuant to Chapter 163, Florida Statutes, and under the <br />home rule powers of the City. <br />Section 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the <br />extent of such conflict. <br />Section 5: That if any section, sentence, clause or phrase of this Ordinance is held to be invalid <br />or unconstitutional by a court of competent jurisdiction, then said holding shall in <br />no way effect the validity of the remaining portions of this ordinance. <br />Section 6: This Ordinance shall become effect upon passage on the second reading and signing <br />by the Mayor. <br />-1- <br />
