INSTR# 2022146521 OR BK 10645 PG 3610 Page 1 of 2 <br />07/05/2022 10:19 AM Rcpt: 2475787 Rec: 18.50 DS: 0.00 IT: 0.00 <br />Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller <br />ORDINANCE NO. 1439-22 <br />AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, <br />FLORIDA, AMENDING THE CITY OF ZEPHYRHILLS <br />CODE OF ORDINANCES SECTION 150.01; AND <br />AMENDING SUB -SECTIONS (C), (E) AND (J) OF SECTION <br />7.09.16 AND ADDING SECTION (L) REGARDING MINI - <br />WAREHOUSING AND STORAGE UNITS; SECTIONS <br />2.01.03.12, 2.01.03.15, 2.01.03.17, REGARDING ZONING <br />CATEGORY FLOOR AREA INCREASE OF 0.5 TO 1.0, <br />AMENDING TABLES 7.01.01 AND 7.02.00 REGARDING <br />FLOOR AREA RATIO INCREASE OF THE CITY OF <br />ZEPHYRHILLS LAND DEVELOPMENT CODE; <br />PROVIDING FOR REPEALER, CODIFICATION AND AN <br />EFFECTIVE DATE. <br />WHEREAS, the City Council has determined that it is in the City's best interest to update <br />the Land Development Code from time to time to assure that the Land Development Code <br />adequately meets the needs of the City. <br />WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold <br />public hearing on the 171h day of May, 2022 to consider the proposed text amendment and has <br />recommended approval. <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, <br />Florida, as follows: <br />SECTION 1: Section §150.01, of the City of Zephyrhills Code of Ordinances and Section 7.09.16 <br />of the City of Zephyrhills Land Development Code, Sub -Sections (C), (D), and (E )are repealed <br />and replaced as follows: <br />Section C: The applicant shall provide a site plan with information on the property lines, street <br />lines, curb cuts, type b buffer / landscaping, location of structures including signs, parking spaces, <br />travel lanes and enhanced perimeter screening (enhanced fence / wall); <br />Section E: Height of buildings shall not exceed one story with a maximum height of 15 feet in the <br />CRA and Form -Based Code (FBC). A conditional use petition may be submitted for projects <br />located outside the CRA & FBC for review / consideration that exceed one story — 15 feet; <br />Section 3: Fencing shall be required to shield adjoining properties, as well as the protection of the <br />lessees. The decorative wall / fence shall be of new material with a maximum of six feet in height. <br />Fencing / walls that adjoin residential districts or residential uses shall be a decorative solid <br />masonry, or aluminum with solid pillars at equal intervals. Maintenance of the fence / wall shall <br />be the responsibility of the owner; <br />Section L: Buildings shall conform to Section 7.10.02 (Additional design standards for large retail <br />buildings) <br />The Zoning category definitions of OP, C2 and C3 in the Land Development Code shall reference <br />a floor area ratio increase from .5 to 1.0. <br />Tables 7.01.01 (Density, Area, Height, and Bulk Requirements) and 7.02.00 (Development <br />Standards for Traditional City Center) shall be amended to reflect the floor area ratio increase from <br />0.5 to 1.0. <br />SECTION 4: Repealer <br />Any ordinance or part of any ordinance in conflict herewith is hereby repealed to the extent of any <br />conflict. <br />SECTION 5: Severabilitv <br />- 1 - <br />
