INSTR# 2022191433 OR BK 10681 PG 1006 Page 1 of 4 <br />08/30/2022 09:33 AM Rcpt: 2497456 Rec: 35.50 DS: 0.00 IT: 0.00 <br />Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller <br />ORDINANCE NO. 1440-22 <br />AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA <br />APPROVING A SMALL SCALE FUTURE LAND USE MAP <br />AMENDMENT TO THE CITY'S COMPREHENSIVE PLAN, CHANGING <br />THE FUTURE LAND USE CLASSIFICATION FROM CITY MU (MIXED <br />USE) TO RU (RESIDENTIAL URBAN) AND AMENDING THE CITY'S <br />OFFICIAL ZONING MAP, CHANGING THE ZONING DESIGNATION <br />FROM C3 (GENERAL COMMERCIAL) TO R3 (MEDIUM DENSITY <br />RESIDENTIAL, FOR A PORTION OF PARCELS 14-26-21-0010-03000-0100 <br />AND 14-26-21-0010-03000-0101; PROVIDING FOR CODIFICATION, <br />SEVERABILITY AND AN EFFECTIVE DATE. <br />WHEREAS, the City Council has been given authority by the State of Florida pursuant to Chapter <br />163, Florida Statutes, to amend the Future Land Use Map of the City's Comprehensive Plan upon <br />written consent of the land owners, together with the approval of the City Council for said Future <br />Land Use Map amendment duly expressed by Ordinance; and <br />WHEREAS, the City Council has been given authority by the State of Florida pursuant to <br />Chapters 163 and 166, Florida Statutes, to rezone property within the City Limits upon receipt of <br />written consent of the land owner, together with the approval of the City Council for said rezoning <br />duly expressed by Ordinance; and <br />WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold public <br />hearing on the 19th day of July, 2022 to consider the Future Land Use Map Amendment and <br />Rezoning; and <br />WHEREAS, due public notice of hearing on the proposed Future Land Use Map Amendment and <br />Rezoning was given by the City Council on August 11, 2022, as required by the Zephyrhills Land <br />Development Code, as amended, and Chapters 163 and 166, Florida Statutes; and <br />WHEREAS, the Future Land Use Map Amendment meets the criteria of a small scale map <br />amendment pursuant to Chapter 163, Florida Statutes, and is consistent with the goals, objectives <br />and policies of the Comprehensive Plan; and <br />WHEREAS, the City has determined that the RU (Residential Urban) Future Land Use <br />classification would be appropriate and consistent with the City's Comprehensive Plan; and <br />WHEREAS, the City Council has determined that the R3 (Medium Density Residential) Zoning <br />designation would be appropriate, would be consistent with the RU Future Land Use classification, <br />and would promote the general welfare and encourage proper development within the City. <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, <br />Florida, as follows: <br />Section 1. The Whereas clauses above are true and accurate and are incorporated by reference <br />and made a part of this Ordinance. <br />Section 2. The following lands, lying and being situated in Pasco County, Florida to -wit: <br />PareeFTax ID No.: 14-26-21-0010-03000-0100;14-26-21-0010-03000-0101 <br />Physical Address: 38624 B Avenue; No Address Assigned <br />Legal Description(s): See Exhibits "A" and "B" <br />Acreage: 1.52 Acres (MOL) <br />the Future Land Use classification is hereby amended to RU (Residential Urban) <br />and the Zoning designation is hereby changed to R3 (Medium Density Residential) <br />and included within the boundaries of the City of Zephyrhills, Florida. <br />Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the <br />extent of such conflict. <br />-1- <br />
