INSTR# 2022232782 OR BK 10714 PG 3332 Page 1 of 2 <br />10/28/2022 11:00 AM Rcpt: 2518373 Rec: 18.50 DS: 0.00 IT: 0.00 <br />Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller <br />ORDINANCEAN ' FLORIDA <br />APPROVING „ <br />AMENDMENT TO THE CITY'S COMPREHENSIVE PLAN, <br />THE FUTURE LAND USE CLASSIFICATION FROM COUNTY ROR <br />' r USE); AND <br />ZONINGAMENDING THE CITY'S OFFICIAL ZONING MAP, CHANGING THE <br />DESIGNATION FROM <br />(COMMUNITY COMMERCIAL), FOR PARCEL 03-26-21-0010-00100- <br />0020; PROVIDING FOR CODIFICATION, SEVERABILITY AND AN <br />EFFECTIVE DATE. <br />WHEREAS, the City Council has been given authority by the State of Florida pursuant to Chapter <br />163, Florida Statutes, to amend the Future Land Use Map of the City's Comprehensive Plan upon <br />written consent of the land owners, together with the approval of the City Council for said Future <br />Land Use Map amendment duly expressed by Ordinance; and <br />WHEREAS, the City Council has been given authority by the State of Florida pursuant to <br />Chapters 163 and 166, Florida Statutes, to rezone property within the City Limits upon receipt of <br />written consent of the land owner, together with the approval of the City Council for said rezoning <br />duly expressed by Ordinance; and <br />WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold public <br />hearing on the 16th day of August, 2022 to consider the Future Land Use Map Amendment and <br />Rezoning; and <br />WHEREAS, due public notice of hearing on the proposed Future Land Use Map Amendment and <br />Rezoning was given by the City Council on October 13, 2022, as required by the Zephyrhills Land <br />Development Code, as amended, and Chapters 163 and 166, Florida Statutes and <br />WHEREAS, the Future Land Use Map Amendment meets the criteria of a small scale map <br />amendment pursuant to Chapter 163, Florida Statutes, and is consistent with the goals, objectives <br />and policies of the Comprehensive Plan; and <br />WHEREAS, the City has determined that the MU (Mixed Use) Future Land Use classification <br />would be appropriate and consistent with the city's Comprehensive Plan; and <br />WHEREAS, the City Council has determined that the C2 (Community Commercial) Zoning <br />designation would be appropriate, would be consistent with the MU Future Land Use <br />classification, and would promote the general welfare and encourage proper development within <br />the city. <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, <br />Florida, as follows: <br />Section 1. The Whereas clauses above are true and accurate and are incorporated by reference <br />and made a part of this Ordinance. <br />Section 2.
