<br />EMERGENCY RESOLUTION BY THE CITY COUNCIL OF THE
<br />CITY OF ZEPHYRHILLS DECLARING A STATE OF
<br />EMERGENCY - TROPICAL STORM NICOLE
<br />WHEREAS, the National Hurricane Center has forecast that Pasco County will experience significant
<br />effects from Tropical Storm Nicole, with the Governor of the State of Florida having declared governmental
<br />emergencies due to the threat to life, health, property, welfare or the public peace of the people of the State and
<br />Pasco County; and,
<br />WHEREAS, the incorporated area of the City ofZephyrhills is included in the areas threatened with severe
<br />storm damage; and,
<br />WHEREAS, this severe weather has the potential for causing extensive damage to public utilities, public
<br />buildings, public streets and roads, public drainage systems, commercial and residential buildings and areas; and,
<br />WHEREAS, Section 252.38(3)(a)(5), Florida Statutes, provides authority for a municipal corporation such
<br />as the City ofZephyrhills to declare a state of local emergency for a period of time up to seven (7) days, which may
<br />be extended as necessary in seven (7) day increments, and to waive the procedures and formalities otherwise
<br />required of a municipal corporation by law pertaining to:
<br />a. Performance of public work and taking whatever pmdent action is
<br />necessary to ensure the health, safety and welfare of the community.
<br />b. Entering into contracts.
<br />c. Incurring obligations.
<br />d. Employment of permanent and temporary workers.
<br />e. Utilization of volunteer workers.
<br />f. Rental of equipment.
<br />g. Acquisition and distribution, with or without compensation, of supplies,
<br />materials and facilities.
<br />h. Appropriation and expenditure of public funds.
<br />NOW, THEREFORE, IT IS RESOLVED by the City Council of the City ofZephyrhills this 9th day of
<br />November, 2022, that the above described weather situation poses a serious threat to the life, health, property,
<br />welfare or public peace of the people of the City ofZephyrhills and that a state of local emergency shall be, and is
<br />hereby declared effective November 9th, 2022 at 7:00 p.m. for a period of time up to seven (7) days, which may be
<br />extended as necessary in seven (7) day increments by subsequent resolution, and all territory within the legal
<br />incorporated boundaries of the City of Zephyrhills, Pasco County, Florida shall be embraced by the provisions of
<br />this emergency resolution;
<br />BE IT FURTHER RESOLVED that the City Council for the City of Zephyrhills hereby exercises its
<br />statutory authority, and appoints the City Manager as its representative to implement and enforce the provisions of
<br />this declaration, and waives the procedures and formalities required by law of a municipal corporation, as authorized
<br />in Section 252.38(3)(a)(5), Florida Statutes.
<br />All public officials and employees of the City of Zephyrhills are hereby directed to exercise the utmost
<br />diligence in discharge of duties required of them for the duration of the emergency and in the execution of
<br />emergency laws, regulations and directives, state and local.
<br />", All citizens are called upon and directed to comply with necessary emergency measures, to cooperate with
<br />public officials and civil emergency/disaster service forces in executing emergency operational plans and to obey
<br />and comply with the lawful directions of properly identified public officers.
