OR BK 10836 PG 607 Page 2 & 3 <br />Public Records of Pasco, Florida; thence departing said South boundary, coincident with <br />said East boundary, S 00 03' 32" E distance 10.51 feet to apoint marking the Southeast corner <br />of said lands; thence departing said East boundary, coincident with the South boundary of <br />said lands and the Westerly extension thereof, S 89 49'28" W a distance of 308.00 feet to <br />a point marking the Northeast corner of the lands described in Official records Book 7631, <br />Page 1180 of the Public Records of Pasco County, Florida; thence coincident with the <br />East boundary of said lands, S 00 03'32" E a distance of 260.46 feet to a point marking the <br />Southeast corner of said lands and the Westerly extension thereof, S 89 49'45" W a distance <br />of 788.60 feet to a point coincident with the East right-of-way boundary of 20th Street; <br />thence coincident with said East right-of-way boundary, N 00 04'24" W a distance of <br />187.89 feet to the POINT OF BEGINNING. <br />Containing an area of 332,793.85 Square Feet, 7.640 acres, more or less. <br />Section 2. Said lands are contiguous to or is infill of the present City limits of the <br />City of Zephyrhills. That said lands are now unincorporated and lie in the same County <br />as said City, and when annexed would form a compact addition to the incorporated <br />territory of said City. That the owners of said lands contained in the said area to be <br />annexed have given written consent to have such annexation for said area. This annexation <br />is subject to the following conditions: <br />i. Installation of a 14 -foot sound attenuation barrier to be located at the <br />south and east perimeter of the proposed expansion of the parking <br />area. Barrier shall be a type designed for Industrial, Commercial, <br />Institutional, Roads, Highways & Bridges, Rail, and Residential <br />Developments. This system shall be manufactured with slots on the <br />front face of the panel and acoustic mineral wool enclosed within the <br />absorptive panel, and include proven and tested properties to <br />consistently reduce noise. This wall shall include noise reflective <br />panels in addition to absorptive panels. <br />ii. Where feasible, an increased "Type C" landscape buffer between <br />the subject's southern property boundary and abutting the <br />Woodland Acres neighborhood consisting of not less than a 50% <br />increase in the required canopy trees and understory trees, as <br />required by the LDC (shrubs shall not qualify as additional <br />required material), and; <br />iii. Payment of tree mitigation fees for removal of trees over and above <br />maximum allowed to be removed, as described per the LDC, and; <br />iv. Site lighting that reduces glare and lightpollutionon abutting Woodland <br />Acres neighborhood and is in conformance with any and all FAA <br />regulations due to proximity of runway approach(s) (if applicable). A <br />photometric plan shall be submitted indicating such conformance and <br />reduction of light pollution on abutting Woodland Acres <br />neighborhood. <br />Section 3. The City of Zephyrhills, Florida, is authorized by the legislature of the <br />State of Florida, pursuant to Section 171.044, F.S., and pursuant to the Charter of the <br />City of Zephyrhills, to annex contiguous or infill areas and to extend the City limits or <br />territorial boundaries upon receipt of written consent of all owners of land contained in <br />the area to be annexed, together with the approval of the City Council of the City of <br />Zephyrhills, of said annexation duly expressed by Ordinance. <br />Section 4. It is the intention of the City Council of the City of Zephyrhills, Florida to <br />annex the above-described lands to said City within its territorial limits and the boundary <br />lines of said City are hereby redefined and extended so as to include said area of lands <br />within its territorial limits upon the final passage of this Ordinance. <br />Section 5. This Ordinance shall become effective upon passage on the second reading <br />and signing by the Mayor. <br />The foregoing Ordinance No. 1458-23 was read and passed on the first reading, in an <br />open and regular meeting of the City Council of the City of Zephyrhills, Florida, on this <br />8 h day of May, 2023. <br />-2- <br />
