OR BK 10895 PG 1809 Page 2 of 3 <br />departing said South boundary, coincident with said East boundary, S 00°03'32" E a distance <br />of 10.51 feet to a point marking the Southeast corner of said lands; thence departing said <br />East boundary, coincident with the South boundary of said lands and the Westerly extension <br />thereof, S 89°49'28" W a distance of 308.00 feet to a point marking the Northeast corner of <br />the lands described in Official Records Book 7631, Page 1180 of the Public Records of Pasco <br />County, Florida; thence coincident with the East boundary of said lands, S 00°03'32" E a <br />distance of 260.46 feet to a point marking the Southeast corner of said lands; thence departing <br />said East boundary, coincident with the South boundary of said lands and the Westerly <br />extension thereof, S 89°49'45" W a distance of 788.60 feet to a point coincident with the <br />East right-of-way boundary of 20th Street; thence coincident with said East right-of-way <br />boundary, N 00°04'24" W a distance of 187.89 feet to the POINT OF BEGINNING. <br />Containing an area of 332,793.85 Square Feet, 7.640 acres, more or less. <br />Section 2. Said lands are contiguous to or is infill of the present City limits of the City <br />of Zephyrhills. That said lands are now unincorporated and lie in the same County as said <br />City, and when annexed would form a compact addition to the incorporated territory of <br />said City. That the owners of said lands contained in the said area to be annexed have <br />given written consent to have such annexation for said area. This annexation is subject to <br />the following conditions: <br />i. Installation of a 14 -foot sound attenuation barrier to be located at the <br />south and east perimeter of the proposed expansion of the parking area. <br />Barrier shall be a type designed for Industrial, Commercial, <br />Institutional, Roads, Highways & Bridges, Rail, and Residential <br />Developments. This system shall be manufactured with slots on the <br />front face of the panel and acoustic mineral wool enclosed within the <br />absorptive panel, and include proven and tested properties to <br />consistently reduce noise. This wall shall include noise reflective <br />panels in addition to absorptive panels. <br />ii. Where feasible, an increased "Type C" landscape buffer between the <br />subject's southern property boundary and abutting the Woodland Acres <br />neighborhood consisting of not less than a 50% increase in the required <br />canopy trees and understory trees, as required by the LDC (shrubs shall <br />not qualify as additional required material), and; <br />iii. Payment of tree mitigation fees for removal of trees over and above <br />maximum allowed to be removed, as described per the LDC, and; <br />iv. Site lighting that reduces glare and light pollution on abutting Woodland <br />Acres neighborhood and is in conformance with any and all FAA <br />regulations due to proximity of runway approach(s) (if applicable). A <br />photometric plan shall be submitted indicating such conformance and <br />reduction of light pollution on abutting Woodland Acres neighborhood. <br />Section 3. The City of Zephyrhills, Florida, is authorized by the legislature of the State <br />of Florida, pursuant to Section 171.044, F.S., and pursuant to the Charter of the City of <br />Zephyrhills, to annex contiguous or infill areas and to extend the City limits or territorial <br />boundaries upon receipt of written consent of all owners of land contained in the area to <br />be annexed, together with the approval of the City Council of the City of Zephyrhills, of <br />said annexation duly expressed by Ordinance. <br />Section 4. It is the intention of the City Council of the City of Zephyrhills, Florida to <br />annex the above-described lands to said City within its territorial limits and the boundary <br />lines of said City are hereby redefined and extended so as to include said area of lands <br />within its territorial limits upon the final passage of this Ordinance. <br />Section 5.
