<br />AMENDINGAN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA,
<br />TO EXTEND THE „,
<br />MORATORIUM ORECEIVING AND PROCESSING/
<br />PERMIT APPLICATIONS FOr RECREATIONAL VEHICLE STOr .
<br />MATERIAL LAYDOWN AREAS AND INDOOR STORAGE FACILITIES;
<br />PROVIDING O' CONFLICTS, SEVERABILITY,EXPIRATION 1 .
<br />DATE.EFFECTIVE
<br />WHEREAS, as provided in section 2(b), Article VIII of the Constitution of the State of
<br />Florida, and section 166.021(1), Florida Statutes, the City of Zephyrhills, Florida (the "City"), a
<br />municipal corporation, enjoys all governmental, corporate, and proprietary powers necessary to
<br />conduct municipal government, perform municipal functions, and render municipal services, and
<br />may exercise any power for municipal purposes, except as expressly prohibited by law; and
<br />WHEREAS, as provided in section 166.021(3), Florida Statutes, the governing body of
<br />each municipality in the state has the power to enact legislation concerning any subject matter
<br />upon which the state legislature may act, except when expressly prohibited by law; and
<br />WHEREAS, the City of Zephyrhills passed Ordinance 1455-23 on February 27, 2023 to
<br />establish a temporary moratorium on receiving and processing plans and permit applications for:
<br />Recreational Vehicle Storage, Material Laydown Areas, and Indoor Storage Facilities with an
<br />expiration date of February 27, 2024; and
<br />WHEREAS, the City of Zephyrhills staff is still reviewing and preparing standards to be
<br />implemented for storage facilities as described herein and is requested additional time, not to
<br />exceed six (6) months from the effective date of this Ordinance.
<br />SECTION 1. FINDINGS OF FACT. The above "Whereas" clauses are deemed findings
<br />of fact and are adopted herein.
<br />SECTION 2. EXPIRATION. The expiration date of Ordinance 1455-23 shall be the
<br />earlier of six (6) months after the adoption of this Ordinance, or the final adoption of an ordinance
<br />regulating Recreational Vehicle Storage, Material Laydown Areas, and Indoor Storage Facilities.
<br />SECTION 3. CONFLICTS. All ordinances or parts of ordinances in conflict with any
<br />of the provisions of this Ordinance are hereby repealed to the extent of such conflict.
<br />SECTION 4. SEVERABILITY. If any section, subsection, sentence, clause, phrase,
<br />word or provision of this Ordinance is for any reason held invalid or unconstitutional by any court
<br />of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion
<br />shall be deemed a separate, distinct and independent provision, and such holding shall not affect
<br />the validity of the remaining portions of this Ordinance.
<br />SECTION 5. EFFECTIVE DATE. This Ordinance shall become effective pursuant to
<br />the Zephyrhills Charter.
<br />The -foregoing Ordinance No. 1477-24 was read and passed on the first reading in an open
<br />and re aF g, of the City Council of the City of Zephyrhills, Florida, on this 26th day of
