September 17, 2013 WELLS FARGO AGRIBOARD PANEL REPAIR 501-2717-033 <br />ZEPHYR COMMONS <br />Add the following subparagraph: <br />References in these Contract Documents to standards including trade associations, federal and <br />military specifications, technical societies, organizations, and associations, codes and government <br />authorities whether specific or by implication shall refer to the latest issue or edition in effect 30 <br />days, prior to date of receipt of Bids or date of the Agreement, if there were no Bids. The provisions <br />of referenced standards shall not change the duties and responsibilities of the Owner, the <br />Contractor, or the Architect or nay of their consultants, agents or employees. <br />Add the following subparagraph: <br />1.2.4 Compute dimensions; do not obtain by scaling drawings. In case of any discrepancy <br />between Drawings and Specifications, consult Architect before proceeding with the work. <br />ARTICLE 2; OWNER <br />Delete subparagraph 2.2.1. <br />Delete subparagraph 2.2.5 and substitute the following: <br />2.2.5 The Contractor will be furnished free of charge 5 copies of Drawings and Project Manuals. <br />Additional sets will be furnished at the cost of reproduction, postage and handling. <br />ARTICLE 3; CONTRACTOR <br />3.2 Review of Contract Documents and Field Conditions by Contractor <br />Add the following subparagraphs 3.2.5 and 3.2.6 <br />3.2.5 The contractor shall have a continuing duty to read, carefully study and compare each of the <br />Contract documents, the shop drawings and the product data and shall give written notice to the <br />Architect and Owner of any inconsistency, ambiguity, error and omission which the Contractor may <br />discover, or should discover with reasonable diligence, with respect to these documents before <br />proceeding with the affecting Work. The issuance, or the express or implied approval by the Owner <br />or Architect of the Contract Documents, shop drawings, or project data shall not relieve the <br />Contractor of the continuing duties imposed hereby, nor shall any such approval be evidence of the <br />Contractor's compliance with the Contract. The Owner has requested the Architect to only prepare <br />documents for the Project, including the Drawings and Specifications for the Project, which are <br />accurate, adequate, consistent, coordinated, and sufficient for construction. HOWEVER, THE <br />OWNER MAKES NO REPRESENTATIONS OR WARRANTY OF ANY NATURE WHATSOEVER <br />TO THE CONTRACTOR CONCERNING SUCH DOCUMENTS. By the execution of the <br />Agreement, the Contractor acknowledges and represents that it has received, reviewed and <br />carefully examined such documents, has found them to be complete, accurate, adequate, <br />consistent, coordinated and sufficient for construction and that the Contractor has not, does not, and <br />will not rely upon any representation or warranty by the Owner concerning such documents as no <br />such representation or warranty has been or is hereby made. <br />3.2.6 The Contractor shall perform no part of the Work at any time without adequate Contract <br />Documents or, as appropriate, approved shop drawings, product data or samples for such portion of <br />the Work. If the Contractor performs any of the Work knowing it involves a recognized error, <br />inconsistency or omission in the Contract Documents without such notice to the Architect and <br />SUPPLEMENTARY CONDITIONS 00800-2 <br />
