September 17, 2013 WELLS FARGO AGRIBOARD PANEL REPAIR 501-2717-033 <br />ZEPHYR COMMONS <br />3.7.3 If the Contractor performs Work knowing it to be contrary to laws, statutes, ordinances, <br />building codes, and rules and regulations (including the Americans with Disabilities Act) without such <br />notice to the Architect and Owner, the Contractor shall assume appropriate responsibility for such <br />Work and shall bear the cost attributable to correction. <br />3.10 Contractor's Construction Schedules <br />Delete subparagraph 3.10.1 and substitute the following: <br />3.10.1 The Contractors, promptly after being awarded the Contract, shall prepare and submit for the <br />Owner's and the Architect's information a Contractor's construction schedule for the Work. The <br />schedule shall no t exceed time limits current under the Contract Documents, shall be revised no <br />less frequently than monthly and at appropriate intervals as required by the conditions of the Work <br />and Project, shall be related to the entire Project to the extent required by the Contract Documents, <br />and shall provide for expeditious and practicable execution of the Work. Each such revision shall be <br />furnished to the Owner and the Architect. Failure by the Contractor to strictly comply with the <br />provisions of this Paragraph shall constitute a material breach of the Contract. <br />3.11 Documents and Samples at the Site <br />Delete paragraph 3.11 and substitute the following: <br />3.11 The Contractor shall continuously maintain at the site, for the benefit of the Owner and the <br />Architect, one record copy of the Contract Documents marked to record on a current basis changes, <br />selections and modifications made during construction. Additionally, the Contractorshall maintain at <br />the site for Owners and Architect the approved shop drawings, product data, samples and other <br />similar required submittals. Upon final completion of the Work, all of these record documents shall <br />be delivered to the Owner. <br />3.14 Cutting and Patching <br />Add the following subparagraph 3.14.3: <br />3.14.3 Contractor further agrees that if the work or a portion thereof is performed adjacent to or in <br />the vicinity of facilities that are used for Owner's financial services operations, the Contractor shall <br />comply with any instructions by Owner with respect to storage, access to and from site, and <br />measures required to reduce noise levels, dust and debris. <br />3.15 Clean Up <br />Delete subparagraph 3.15.1 and substitute the following: <br />3.15.1 The Contractor shall keep the premises and surrounding area free form accumulation of <br />waste materials or rubbish caused by operation under the contract. At completion of the Work, the <br />Contractor shall remove from and about the Project waste materials, rubbish, the Contractor's tools, <br />construction equipment, machinery and surplus materials and the site shall be left in "broom clean" <br />condition. <br />3.18 Indemnification <br />Delete subparagraph 3.18.1 and substitute the following: <br />SUPPLEMENTARY CONDITIONS 00800-4 <br />
