I <br />J. Contractors shall not open any type of charge account within the Store and store markdowns will not be allowed. <br />' All items purchased in the Store shall be paid for at the time of purchase. Contractors should not receive any <br />discounts for any items purchased within the Store. The use of Wal-Mart's name will not be allowed on any <br />accounts. <br />K. Contractors shall comply with Wal-Mart policy regarding gratuities. No Contractor may receive any gratuities <br />from any company providing services or materials for any Wal-Mart Projects. Contractors are not entitled to <br />receive any employee benefits from Wal-Mart. <br />L. The Remodel General Contractor shall be responsible for timely removal of the construction trailer as directed by <br />the Wal-Mart Construction Manager. <br />' M. Wal-Mart may provide Store Associates as required to assist the Remodel General Contractor and Separate <br />Contractors in the remodeling. The Wal-Mart Store Planning Field Project Manager will determine the number of <br />Store Associates that will be provided on a job basis. Wal-Mart Store Associates shall not be allowed to operate <br />power equipment, be used as carpenters, or perform work from scaffolds, ladders or hoists. <br />N. The Remodel General Contractor and Separate Contractors are responsible for obtaining a final inspection from <br />the appropriate Building Official or Authority Having Jurisdiction (AHJ). If a Certificate of Occupancy is <br />required, obtain it from the proper authorities. A copy of all final inspection documentation or Certificates of <br />Occupancy shall be included in the final Closeout Documents (Maintenance Book/Closeout Book). <br />1.6 RESPONSIBILITIES OF THE BUILDING ADDITION GENERAL CONTRACTOR <br />A. The Building Addition General Contractor shall provide necessary forces and subcontractors to complete the Work <br />' of the Project as described in the Contract Document (Drawings, Specifications, Addenda, and other modifications <br />to the Contract). He is responsible for the supervision, quality control and costs for his employees and <br />subcontractors. <br />B. The Building Addition General Contractor shall carefully coordinate his scope of work with that of the <br />Remodeling General Contractor and Wal-Mart Separate Contractors and discuss any potential conflicts with the <br />Wal-Mart Construction Manager. It remains the responsibility of the Building Addition General Contractor to <br />interface with all other Contractors (Trades) on the job. <br />C. Contractors shall comply with Wal-Mart policy regarding gratuities. No Contractor may receive any gratuities <br />from any company providing services or materials for any Wal-Mart Projects. Contractors are not entitled to <br />receive any benefits from Wal-Mart. Contractors shall not receive any discounts for any items purchased within <br />the Store. <br />D. The Building Addition General Contractor is responsible for complying with all federal, state, and local codes, <br />regulations, ordinances of the Authorities Having Jurisdiction (AHJ) and for obtaining all Final Inspections and <br />Certificate of Occupancy from the appropriate Authority Having Jurisdiction (AHJ). <br />1.7 RESPONSIBILITIES OF WAL-MART <br />A. Wal-Mart Store Planning Field Project Manager shall coordinate with the Remodel General Contractor the <br />delivery of all Wa1-Mart-furnished items to the job site. <br />B. The Wal-Mart Store Planning Field Project Manager shall be responsible for the following construction <br />coordination items: <br />1. Supervision and coordination of Store Associates assisting with construction. <br />2. Unloading of fixture trucks and the organization of the off site warehouse. <br />3. Transportation of certain Wal-Mart-provided materials required for construction from the warehouse to the <br />Store. <br />4.
