LiQuidated l>ama!Ies As actual damages for breach of the contract prior to commencement of work are difficult to ascertain and are uncertain, the parties agree as follows. (a) Prior to commencement at work or furnishing of materials, Ten Percent (10%) of the cash price stated in the contract (or the maximum amount allowed by Florida law) will be considered as liquidated damages, and not as penalty or forferture. (b) Once labor, services and/or materials are furnished. Permaguard Induslries. Inc. will be entitled to actual damages upon Purchaser's breach of the contract. (Actual damages are defined as the actual cost of irnprowments to the date of the breach of contract, pius 10%). 5. Attorney's Fees.
