LiQuidated l>ama!Ies As actual damages for breach of the contract prior to commencement of work are difficult to ascertain and are uncertain, the parties agree as follows. <br />(a) Prior to commencement at work or furnishing of materials, Ten Percent (10%) of the cash price stated in the contract (or the maximum amount allowed by Florida law) will be considered <br />as liquidated damages, and not as penalty or forferture. <br />(b) Once labor, services and/or materials are furnished. Permaguard Induslries. Inc. will be entitled to actual damages upon Purchaser's breach of the contract. (Actual damages are defined <br />as the actual cost of irnprowments to the date of the breach of contract, pius 10%). <br />5. Attorney's Fees.
