The <br />homeowner's signature on the installation list indicates that he or she is thf party res- <br />ponsible for the work. If the contractor obtains the permit, the contractor s signature <br />on the installation list indicates his responsibility for the work. If the contractor s <br />work is defective, the County will require corrective action by the party who took out the <br />permit and signed the installation list. Furthermore, if the contractor is not licensed <br />as required by law, the homeowner can be violating state law by permitting an unlicensed <br />person to do this work, The penalty for the violation is a m1sdemeanor. For your pro- <br />tection, make the contractor si~n the installation list. If the contractor wishes you to <br />sign it, that is a good indicat10n that he is not qualified or licensed to do the work, <br /> <br />Since you or your contractor have applied for a building permit for work to be done on <br /> <br />property owned by you, you should be aware of the following: <br /> <br />Any person who furnishes labor (a contractor, subcontractor, or laborer) or <br />supplies materials for repairs, improvements, or new construction may be enti- <br />tlea to a lien against your property if he is not paid in full by your contrac- <br />tor, even though you have pa1d the contractor in full. <br /> <br />In order for your payments to your contractor to be "proper payments", there are certain <br />steps you may take in accordance with Florida's Mechanics Lien Law. Although these steps <br />are optional, they may afford you some protection, <br /> <br />1. Before any work is begun by you or your contractor, file a Not:ice of Commencement <br />with the Clerk of the Circuit Court. Florida St~tutes, Section 713.13, specifies <br />the information required on the Notice of Commencement. <br /> <br />2. Before you file the Notice of Commencement, be sure to check with your construction <br />moneylender, as premature filing may affect your loan. <br /> <br />3. Post a certified copy of the Notice of Commencement in a conspicuous place on the <br />front of the pro:perty where the work will take place. The notice must be J?osted <br />before any work 1S started, but not more than tnirty (30) days before work 15 be- <br />gun. <br /> <br />4. Upon completion of the work, require a sworn statement (affidavit) from your con- <br />tractor which states that he has paid all bills for labor and materials or lists <br />those oersons or firms which have not been paid and the amount due each. Require <br />this atfidavit before making final payment to your contractor. <br /> <br />For added protection, you may request that your contractor furnish you with a performance <br />andlor payment bond. You or your contractor on your behalf can obtain a bond through most <br />general lines insurance agents. While the cost of the bond will be borne by the owner, it <br />provides the most complete protection available against the possibility of having to pay <br />t\l.'ice. <br /> <br />NOTICE OF DEED RESTRICTIONS <br /> <br />111is permit may be subject; to "Deeu Restrictions" which are more restrictive than County <br />regulations. Every permit issued shall become 1nvalid unless the work <br />authorized by such permit is commenced within six months after its issuance, or if the <br />work authorized by such permit is suspended or abandoned for a period of six months <br />after the time the work is commenced. One or more extensions of time, for periods not <br />more than 90 da)'s each, may be allowed for the permit. The extension snaIl be re- <br />quested in \I.'rit1ng to the Building Official.
