<br />UInited Wmano/ include, wiIbout limitation: (a) damage ID the Shingles caused by
<br />acts of God, such as hailstorms and hurricanes; (b) damage ID the Shingles caused by
<br />any distonion or movement of the roof deck, walla, or foundation of the buiJding; (c)
<br />claims by subsequent ownas or transferees. (IliJS IlMITED W AF.RANTY IS
<br />PERSONAL TO TI-IE ORIGINAL OWNER AND IS NOT ASSIGNABLE OR
<br />TRANSFERABLE UNDERANYORCUMSTANCESJ; (d) application not in accord

<br />caused by any application of cleaning solutions, paints, coatings or modifications of
<br />any kind; (l) damage ID the Shingles caused by traffic (walking on the root), misuse,
<br />negIea, or improper haodIin& or use of the Shingles before, ciuIiDi a _
<br />instaIJalion; (g) damage ID the ShqIes caused by deddng nails or stapIa badcing out
<br />and either perforating or pushing up the Shing\es; (h) damage ID the ShlngIes caused
<br />by improper ventilation or dminage; or (i) variatico in the color of ShinsIes widtin a
<br />batch and/or between batches ("Shading") which may occur from the positioning of
<br />the gr.mular surfacing material used on the ShinaJes. Further, any expenses incurred
<br />for an unauthorized replacement or for the cost of replacement incurred prior to
<br />written aclcnowIedgment of ELK's responsibilio/ are not covered by chis Limited
<br />Warrano/ and ElK shall not be responsible for any such expenses.

<br />HOW TO MAKE A ClAIM: To request performance of any obligation asserted
<br />under this Limited Warrano/, you must, within thirty (30) days of discovery of a
<br />problem, send writlm notification of the alleged dem:r with a copy of your warranty
<br />card and proof of purchase of the Shingles ID ElK at P.O. Box 3450, Tuscaloosa.

<br />HOW ClAIM WII.L BE HANDlED: Within a reasonable period of time from
<br />receipt of the claim, copy of waaano/ card and proof of purchase, ElK will review
<br />your letter and may ask for samples of the ShinaJes and photographs showing the
<br />emnt of the probIan. The Owner iI responsible for providing these, and any other
<br />materials reasonably ~ted. at the Owner's expense. The Owner must allow
<br />reasonable time for investigation, including roof top inspection by an ELK employee
<br />and laboratory trsting of the suspect product. ANY ClAIM FOR SHINGLES
<br />WHIG{ HAVE BEEN REPlACED PRIOR TO ELK'S RECEIPT OF WRITTIN
<br />NOTICE AND ON-Sill INSPECTION SI-Wl. BE DENIED. If the investigation
<br />reveals manufacturing defects cavem\ by chis limited Wmano/, ELK will provide,
<br />within a reasonable period of time, a settlement in accordance with the conditions of
<br />the Limited Warrano/.

<br />UMlTED W ARRANlY ELK warrants to the original consumer purchaser
<br />("Owner') that the Prestique shingles described below ("Shingles'): (1) are &ee
<br />from manufacn.uing defects that would adversely affect the performance of the
<br />Shingles; (2) 'Mil be resistant to blow-offs in wind velocities up to 60 miles per
<br />hour durinll the first five (5) years after installation, provided the thermal sealant
<br />has properly activated (SEE TI-IE DETAILS IN THE SEPARATE UMITF.D WIND
<br />WARRANTY SET FOR1H BELOW); and (3) when manufactured with Stain-
<br />Guard~ a-eannent, 'Mil retard the growth of most al.Itae and fungus which
<br />adversely affect the appearance of roofs for the first five (5) years after installa-
<br />tion. This Umited Warran"Cf commences at the completion of the installation of
<br />the Shingles and continues for the warrano/ period described below.

<br />The useful life of a given Shingle may be ~ by many factors including: the
<br />weather conditions to which it is exposed; the qualio/ of its installation; the type
<br />and quali"Cf of the construction, including the roof ~ and ventilation; and
<br />other factors over which ELK has no connnl. This UmireaWarrano/ desaibes
<br />your remedy in the event your Shingles are found ID have defects in material or
<br />manufacturing wotkmanship which affect performance before the expiration of
<br />the stated warrano/ period. Any limited watrano/ does not assure that the
<br />covered products will last the entire length of the Slated warrano/ period.

<br />UMIT A TION OF llABI1lTY: This Umited Warrano/ is the sole and exclusive
<br />remedy provided ID the Owner of the Shingles containing manufacturing
<br />defects affecting performance during the period specified below. To the extent
<br />of those Shingles acwa1ly containing defects in material or manufacturing
<br />workmanship which affect performance, ELK shall either: (1) pay the reasonable
<br />replacement cost of shingles and application labor, prorated as set forth below;
<br />or (2) provide replacement shingles only or pay the reasonable cost for
<br />replacem~t s~es of a similar design; or (3) pay the reasonable cost for repair
<br />of the Shingles. The decision on which remedy is used shall be at the sole
<br />discretion of EIJ<. After the first year, the replacement cost which ELK will pay
<br />'Mil be reduced by the amowlt of usage you have received from your Shingles.
<br />ELK will therefore pay you a percentage of the reasonable replacement cost,
<br />described above, which will be calculated by dividing the number of months
<br />remaining in the warran"Cf per!od by the number of months in the original
<br />warrano/ period. In the unlikeJy event the entire roof is found to be ddective,
<br />ELK shall provide, or pay the reasonable replacement cost of. shingles and
<br />reasonable application labor to re-cover the roof. Any payment made by ELK
<br />shall be reduced by prorating as specified above for each month of the Owner's
<br />use of the S~. ELI<. wherever possible, shall replace Shingles with shingles
<br />of the same colOr and design. However, since color variations exist between
<br />shingles manufactured at different times and since ELK may discontinue or
<br />modify its shinldes, ELK reserves the right to replace defective Shingles with
<br />shingles of similar color and/or design. The application costs covered by this
<br />Limited Warrarto/ do not include costs for trar-{)ff, dump fees, Bashing, metal
<br />work, underlayment or related worK.
