L. STEVE CONSTRUCTION, of 37746 Glades Lane, Zephyrhills, Fla., <br />(BUILDER), and Mrs. Ann;rp Arnn (BUYER), at <br /> <br />In consideration of the mutual promises, covenants, and conditions contained <br />herein, BUILDER and BUYER agree as follows: . <br /> <br />1. BUILDER agrees to construct a residential dwelling and BUYER agrees to <br />employ BUILDER to construct the dwelling on property located at Lot. #')0 <br />of Silver Oaks in Pasco County, Florida, and <br />legally described as follows: <br />Lot #50 at Silver Oaks, recorded in Public Records of Pasco County, Florida, <br />in Map Book 26, Pages 46 through 49. See Lot Purchase Agreement attached hereto. <br /> <br />2. The dwelling is to be constructed thereon in accordance with plans and <br />specifications that have been approved and signed by BUYER and BUILDER, and at- <br />tached hereto and made a part hereof as EXHIBITS "A" thru E . All items con- <br />sidered standard by BUILDER except as noted are attached as EXHIBIT "B". <br /> <br />3. PRICE. CONSTRUCTION. The dwelling shall be constructed pursuant to generally <br />accepted standards of the construction industry and substantially completed \,ith- <br />in 120 days of issuance of the building permit, or within a reasonable time there- <br />after, subject to delays and other conditions beyond the control of BUILDER. <br />BUILDER agrees to pursue construction of the dwelling diligently to completion. <br /> <br />5. INSULATION. LIMITED ONE-YEAR WARRANTY AND LIMITED DAMAGES. BUILDER shall warrant, <br />in writing, the dwelling construction against defects in workmanship and materials <br />for a period of one (1) year from the date of occupancy or closing, whichever <br />first occurs, except to the extent such defects are caused by the negligence or <br />improper acts of BUYER OR ANY PERSON OTHER THAN BUILDER. BUYER shall be obligated <br />to notify BUILDER in writing at its office in Zephryhills, Florida, of any defects <br />covered by BUILDER'S express warranty on the dwelling and BUILDER shall make or <br />authorize repairs as shall be necessary to correct such defects, as promptly as is <br />reasonably possible.
