STEVE CX>NSTRUCTION <br />37746 GLADES LN. <br />ZEPHYRHILLS, FL 33541 <br />(813) 782-9442 <br /> <br />CX>NSTRUCT ION AGREEMENT <br /> <br />Inconsideration of mutual promises, covenants and conditions contained in <br />this agreement, both Contractor and Owner agree as follows: <br /> <br />For purposes of clarification and identification, the following definitions <br />shall apply. <br /> <br />Cll'll'RAC'I"m. is hereby identified as Gary L. Steve, D/B/A G.L. Steve Construction. <br /> <br />Cll'll'RAC'I"m.'S AGENT shall be authorized by Contractor to act in his behalf in a <br />limited capacity on site for coordination and facilitation purposes only. <br /> <br />OWNER is hereby identified as The First United Methodist Church of <br />Zephyrhills, Florida. <br /> <br />OWNER'S AGENT shall be duly authorized by Owner to act in their <br />behalf as may be required to facilitate construction activity. <br /> <br />BUILDING shall be identified as a new Parsonage for Owner to be <br />located on 5th Ave. and 18th St. in Zephyrhills, Florida. <br /> <br />EXHIBIT "A" is attached hereto and made a part hereof and shall <br />consist of sufficient plans, specifications, legal descriptions-- <br />and other data that may be required in order for Contractor to <br />fulfill his obligations under the terms of this agreement. <br /> <br />THE CONTRACTOR agrees to construct a building to be used by Owner <br />as a new Church facility. <br /> <br />The Owner agrees to employ the Contractor to construct the Building <br />accord i ng to pI ans & spec"i fica t ions furni shed by the Owner as <br />reflected in Exhibit "A". <br /> <br />The Building shall be constructed pursuant to generally <br />accepted standards of the construction industry and conformity to <br />applicable laws - rules - regulations. If, during construction, <br />the plans and specifications furnished by Owner conflict with <br />regulatory authority, the Owner/Architect will resolve the matter <br />with the Contractor as quickly as possible. <br /> <br />The Contractor shall be privileged to review certain portions <br />of the financing agreement to ascertain availability of sufficient <br />funds in a timely manner, according to a Construction and Draw <br />Schedule to be agreed upon by Owner, and Contractor. <br /> <br />The Contractor shall open a "Special Construction Account" to <br />be used specifically for paying labor, materials, and applicable <br />invoices directly related to construction of the Building. <br /> <br />The Owner shall cause this account to be sufficiently funded <br />to satisfy invoices or accounts payable, directly related to <br />construction of the Building. The account shall require two <br />signatures for disbursement. One shall be an authorized agent of <br />the Owner, the other shall be the Contractor. Sufficient time <br />shall be given to the Owner (five working days) to transfer or <br />deposit funds into the construction account. <br /> <br />Once account is established, bills and invoices received by <br />Wednesday shall be payable by Friday. <br />
